Question regarding ILR and dependants

Post by legorn » Fri Apr 05, 2013 12:49 pm

Hello,

After August next year, I will be eligible to apply for the ILR. However, I got married last December and even though my wife has already her visa, she will not have the required two years in the UK in order to get the ILR at that time (August 2014).

Her visa expires in October 2014 (mine too). My question is: if I apply for ILR then, will my wife get an extension of her current visa until she completes the required two years in UK? Or should I apply just for one more extension of my Tier 1 visa so that we can both apply for ILR at the same time?

Thanks in advance for your advice!

Unfortunately, since 9 July 2012, the rules for dependants have been changed from two years to five years.

Ok. Thanks for the info, Vinny.

In any case, if I understand correctly, next year I should apply for ILR for myself.... and my wife (on a separate application) for an extension of her current visa. Am I right?
