Eligibility criteria: AN 6(2) - Non-EEA spouse of a dual Swiss/British national
Method of application: NCS
Date of application: 22/03/13
Date of receipt by UKBA: 26/03/13
Date of debit of fees: 03/04/13
Date of acknowledgement : 06/04/13
Date of approval: 13/04/13 received 19/04/13
Date of Ceremony: 01/05/13 public ceremony

I applied as the spouse of a British national having automatically acquired PR under EU Law w/out a PR document. At the NCS appointment the agent advised that I submit all my P60s for 5 years and additional payslips (so the UKBA could establish that I had indeed acquired PR), my husband's Swiss passport, his PR card, his P60s for 6 years and his naturalisation certificate.
So my application first had to be decided under EU law = PR and then under AN 6(2) = as the spouse of a British national.

Hope this helps anyone else in a similar position.

Hi Plum, I'm about to apply for BC same as you based on 6 years of durable relationship led to marriage.
I have received my PR based on 5 years relationship but I'm not waiting for 1 year over PR as they took 13 months to issue my PR, now on that bases(EEA law) I'm eligible for BC but I'm planing to pay a lawyer to submit my application to cover all the explaining and in case of refuse and appeal, she would do it all.
Good luck with your applications and please update us.

HO received on 27/02/2012.
Refusal received on 16/08/2012 dated 11/08/2012
At the court, the HO REP withdrawn the decision and asked me to send the DOC for the time before marriage.

Spike, why not use the NCS service? The agents are expected to be well versed in both EU and UK nationality law and when in doubt have a hotline to the UKBA caseworkers to verify under what section of law an application can be lodged and if all requirements are met. I do not see the benefits of expenses on a lawyer.

Also, if you have strong evidence of your automatic acquisition of PR as well as 6 years of continuos residence in the UK (one under PR), then your application should be pretty straightforward I feel.

Thanks for your great advice, I rather not to pay a lawyer(£400) but my problem is, not all the HO case worker know the rules, I was refused for PR by mistake and took HO 13 months with apology and issued me PR. I'm not sure if the NCS know all the rules too!! but if you think so then is good.
My PR issue date is 05/03/2013 and I was qualified on 07/01/2012( HO took 13 months).
I been with my wife since January 2007 so is 6 years and 3 months but got married 09/2008 so is not even 5 years. But EEA law says as long as durable relationship is all count regardless marriage and that is how I got my PR.
Now I want to apply for BC based on 6 years of the durable relationship(regardless marriage which is 4 years). What do you think? will NSC know about this rule? and what happens if I get refuse with right to appeal? would they help? Do NCS write a cover letter? thank you so much for reading all this.

Hey Spike,

I am conscious of keeping to the aim of this thread which is to post ad update naturalisation timelines so will keep it short:

NCS agents are usually well versed in the applicable laws and where in doubt (as was in my case) contact the UKBA caseworkers who are able to advise further. I do not know if the NCS write cover letters.

You may use a solicitor if you wish but I personally do not think it is necessary.

They can take a little while to debit the fees (a week or so). They will write to you to acknowledge the receipt of your application. If there are issues with the payment, they will also let you know in writing. They work on Saturdays and Sundays I believe, as they debited my payment on a Saturday and the acknowledgement letter was dated as Sunday!

Yes we receive it, but i din`t bother about it because All correspondence were send to my solicitor. My solicitor never contacted me until he got my good news.

we had to wait 1 week for our application to be sent,we booked the NCS appointment for the friday 15/03 but been told it would be sent the week after on thursday the 21st..we checked today the royal mail tracking system and the application was sent on thursday and the home office received it Friday the 22nd ..so,lets hope everything is going to be ok..good luck for everyone who is waiting for a positive outcome.
