ILR for a parent of a british child

hello i am in R card took it october 2012
i been here in uk for a year now
my child is british citzen and got a british passport
now i want to know can i apply for ILR or perment resident

i have some problem with my wife and if something happen like divorce
do i need to retain rights from my eea 2
or should i apply for different catarogy like ILR or somethinn else
