Tier 2 extension - My job title doesn't exist new SOC list

Post by tier2applicant2 » Mon Apr 08, 2013 3:24 pm

Hi

I am due for visa extension end of this year. However, the job tile under which I was granted visa doesn't exist in the new SOC code list. There are other job titles in the same SOC which match the my job responsibilities.

I will be applying in same SOC (old matched to new code) code but different job title. My question is does my employer need to do a RLMT while extending my visa ?

Many Thanks

Could they not state your job title as the same as last year, and use the same SOC code? The job title just has to be covered by the SOC code - it's wording does not have to match precisely. For instance there are loads of music industry jobs that are not precisely listed in the SOCs - the sponsor just has to state the job title and then use the most appropriate code.

We thought the same thing to use the same SOC code and job title as last time but there are few problems

1. We Wouldn't have an indicative salary expectation by UKBA for my job title
2. It get more complicated with increased salary for Experienced workers
3. Old SOC codes doesn't exist anymore

For example my previous SOC

Code 2132 has been scrapped has been categorised to 2135, 2136, 2139 with their own sublisted job titles. My old job title isn't listed in any of three.

So its not very clear which one of three to pick and my employer will not be happy with doing a RLMT.

I would be happy if you could comment on the changes in SOC codes.

presuming your current T2 was granted before 14 June 2012 and since you are applying for extension you have the option of choosing a job title from NQF level 4 if you are finding difficult to satisfy the NQF 6 job salaries.

for eg 3131 IT operations technicians. refer the new set of codes and the related sample job title and salary details

All the best

That would mean applying for COS with a new SOC code from previous one. Would my employer has to do a RLMT ?

Check ur codes on this ur job description should match not ur job title.
Like my previous soc code was 2329 which is divided to 2119 and 2426 though my title comes under 2426 my job description matches word to word for 2119, so I ll use 2119 in future.

Thanks for the response.

So during visa extension. You will be applying for COS with new job title mentioned in 2119 matching your job description. There is no need of doing RLMT in which case.

Am I correct in saying that ?

I will use the same job title but use soc code 2119 as that matches my job description if u want to be sure read this
'You must use the SOC code which best matches the job description rather than the job title. This is because some employers use different job titles to describe the same job. Please do not ask us to match a job title or a job description to a SOC code for you. You know most about what duties and responsibilities the job involves and if you cannot match the job description to a SOC code you should ask for help from the Office for National Statistics .'

Hope this helps

I was given tier 2 visa in May 2011

My concern is not choosing the right SOC code but its about RLMT requirement as my SOC code is changed from my original application.

According to my understanding of the document
http://www.ukba.homeoffice.gov.uk/sitec ... iew=Binary

Look in extension applications u don't need to redo resident labour market test it's only for first applications .
Gurus can you please correct me if I am wrong?

Tier 2 Visa extenion Resident Labour market test

Post by sgeorge56 » Sun Apr 14, 2013 2:40 pm

Hi,

I am in a similar situation. I was previously granted tier 2 visa in august 2010 and am applying for extension of tier 2 on the 1st May. I am not sure if I have to go through a resident labour market test. I was granted leave as a senior care worker on my previous grant of tier 2 visa. Please let me know if senior carers can apply to extend their tier 2 visa on the basis that tier 2 extensions are exempt from resident labour market test

Please let me as I am really worried

thanks
