Tier 2 ICT Expiring need to apply for Tier 2 General -Urgent

I have a Tier 2 ICT which is ending 30 April 2013. Visa start date is April 2010.
I have a sponsorship arranged who are ready to give me Tier 2 General visa.
As per them I can apply for Tier 2 general visa from outside UK.
Can I leave the country and get the new employer to apply for a Tier 2 General?
Or is there "cooling off" period before I can make this application.

unfortunately, you will be subjected to the 12 months cooling-off period, if you apply from outside of the UK, as per the UKBA rules.

Try to remain in the UK and apply from here. You are eligible to swith to T2G but will need an unrestricted CoS from the new sponsor.
