[Urgent]-Time already spent on Student Visa-[HELP]

Post by Deviser » Sat Mar 23, 2013 3:59 pm

A student spent 3 years in UK on student visa from 2003 to 2006, in most famous fake American university (Preston University, USA) for Master level study as per following:

One Year MBA Finance
Six Month Writing-up theses (MPhil)
One Year & Six Month on PhD

That time, Home Office widely accepted Preston University visa letters. But when he was continuing studies for PhD in 2006, he got letter from UK-NARIC about the university is fake and degrees are not recognize. He left Preston and start college Diploma in Information Technology with another private college, where he spent more 15 months. Then he got a good job in home country and left UK in 2008. Roughly, he spent 4.5 or 5 years in UK on student visa.

He officially got his entry clearance visa and visa extension from Home Office on Preston University visa letters exactly as per above courses and then an extension for college diploma.

Now, he is applying for Tier-4 student visa. He got following options:

1.) Level 6 - BA Finance (1 year top-up) from University of Sunderland.
2.) Level 7 - ACCA from BPP University College. (2.5 years)
3.) Level 7 - CIMA from LSBF on Glyndwr University CAS. (2.5 years)
4.) Level 7 - CFA/PGD/CIMA from a Private HTS college. (1 to 2.5 years)

The questions are:

Q1.) How the above period, which is already spent in UK by applicant on student visa, will count now according to new 3, 5 & 8 years visa limitations?

Q2.) Does this fake American university thing may casue a problem with current application? He got all certificates and letters regarding this. He also got a letter (dated 2003) from Home Office which specifically states that Preston University degree course are accpetable as bona-fide institute in UK.

Q3.) Is he still eligible for Tier-4 visa as per above scenario?

Q4.) If yes, which course will be most suitable to get visa in above 4 options?

Actually, he applied in Sunderland for MBA Finance, but Sunderland refuse to recognize his Preston University, USA qualifications, and offer him BA Final year top-up on the basis of his bachelor degree from home country + ACCA Knowledge Level 3 papers.

Rest of sponsors are OK with issuing CAS like BPP for full ACCA and LSBF for full CIMA. The another Level 7 course he is thinking about is CFA with Quartic Training which is HTS but do not have work permission of 20 hours like others.

Can somebody have any idea about these questions according to first post:

The questions are:

Q1.) How the above period, which is already spent in UK by applicant on student visa, will count now according to new 3, 5 & 8 years visa limitations?

Q2.) Does this bad quality American university thing may casue a problem with current application? He got all certificates and letters regarding this. He also got a letter (dated 2003) from Home Office which specifically states that Preston University degree course are accpetable as bona-fide institute in UK.

Q3.) Is he still eligible for Tier-4 visa as per above scenario?

Q1.) - Yes technically any previous study in the UK will be counted whether the student is here or not. I have asked the UK BA this question directly.

Q2.) Shouldn't do but you never know. They may run a credibility interview with the student.

Q3.) If he has already hit the 5 year limit for NQF 6/7 then he may face a visa refusal

Q4.) Best option? Provided he understands how hard CIMA and ACCA are then go for one of them. However I would never study anything through LSBF/Glyndwr.

He got the entry clearance visa on MBA Course. He spent total 3 years in Prestion University which is L7/L8 Master/MPhil/PhD.

Rest 1.5/2 years he spent on College Advance IT Diploma which is Level 5. Than he left UK.

Does the period he spent in college, still be counted at Level 7, as he got entry clerance visa for MBA?
