Earliest possible application date as per cooling period

Hello all,

I currently hold Tier 2 ICT which expires in Feb 2013 but I left UK in Nov 2012 and have not returned since then.
Now as per cooling period clause am I allowed to apply for new Visa only after Nov 2013 OR I can apply but the visa start dates should be after Nov 2013? Basically I want to be sure about the earliest time I can apply for a new Tier 2 General visa.
Kindly advise.

If you provide evidence that you have been outside the UK between Nov 2012 and Feb 2013 then the cooling off period will start the day after you left the UK in Nov 2012.

IMHO, and by reference to 245HB(g) you cannot make a T2G application earlier than 12 months after that date.
