Tier 2 to Ilr

I was with my employer as IGS migrant prior to April 2008 and applied the T2 upon expiry of IGS on 20th of April. My application was refused but appeal was successful and my visa was granted on 1st of October 2008 with the expiry date of 21st of April 2011. I've got an extension until 21st of April which is exact 5 years since my initial tier 2 application.

I am wounding if I could apply the ILR now (5 year since the application) or I have to wait till October. (5 year since the visa stamped)
