Urgent query regarding new form

Hello gurus,

I am applying for Tier 1 General Migrant and this new form has created lots of confusion. Your help would be highly appreciated.

Complete the following table indicating the sources and levels of income as indicated in 5.1 - 5.5 that you and your
partner are relying on to adequately maintain you and any dependants.
5.6

Income Source Interval Received (weekly/monthly) Amount
Total --Vodafone/Monthly/Pay Amount, is that right?

6.1 When did you (the main applicant) first enter the UK? This
refers to the date of your first entry into the UK at the beginning
of the period of stay on which this application is based. - Oct 2004 in my case

6.2 Since then have you had any absences from the UK? If yes, give the dates you left and returned to the UK and the reason for the absence in the spaces below. List all absences however short and in date order. If you need more space, continue on a separate sheet and enclose it with your application. Do i just need to enter the absences from last 5years?


7.12. Please state what ties you have with;
• The country where you were born
• Any other country whose nationality you hold
• Any country where you have lived for more than 5 years

Do I need mention the names of my parents or just say my parents live in India?

Letter(s) from employer(s) detailing reasons for work-related absences including periods of paid annual leave from the UK? Does Tier 1 General Migrant also needs to provide the letter of evidence?

5.6 You need to give Income Source/ Amount/ How often you receive

6.1 Date of Entry in 2004.

6.2 In date order your absences from UK

7.12 Just your Parents, close friends,relatives- No names.

Absences from UK -work related./Annual Leave ,Employer's letter is needed.

But employers are unwilling to write if and what I went outside UK. They will just write that during these particular days I was on annual holidays!!!

Wouldn't they write absences from UK were with in the annual leave entitlement.

Does that mean i need to show all my absences from 2004? I know my passport has got all stamps when i enter/left UK but there are so many of them and I don't the remember the correct dates. This is just making things difficult.

I do not understand why this is 2004. Its 2013 now so 5 years ago was 2008 as it says period of stay on which this application is based. The OP entered the UK in 2004 but this application is on his 5 year route.

The question following is directly related to this as it says since then..., so it would mean OP has to explain his absences since 2004?

7.12. Please state what ties you have with;

How is this even relevant to the application requirements. I guess this is so that OP has less rights if he appeals a decision under human rights act, if he shows he has ties outside UK? i.e. he can be deported easily.

For e,g:- You receive £ 3,000/= as your Net salary every month.

Income Source- Monthly salary from your Co. Name
Amount -£ 3,000/=
Frequency- Monthly.

Say,your are a 5year W.P Holder. Applying for ILR 28 days before visa Expiry-4 years and 11 Months you have lived in the UK.

8B _ Other Information

Your aged Parents live with you. You are the carer for them. You provide financial support and meet all their needs.- You could mention any thing on the same lines.Relevant to you or your family.

1) I take your point of 4 years 11 months for the given example....however, that would not be correct if the applicant were to enter UK prior to that on a student visa, would it?
For eg. 3 years as student, 5 years as WP holder, applying for ILR 28 days before 5 year end makes it: 8 years 11 months.

2) Its the space below where its asked again: "Please provide details of any periods of absence of more than 6 months during that time."
How is this different from 6.2??

1. You are correct. My example was to explain to you in simple terms.

2. Absences more than 6 months is different other work related/annual leave absences. It categorically asks for absences more than 6 months.
