I applied as the spouse of a British national having automatically acquired PR under EU Law w/out a PR document. At the NCS appointment the agent advised that I submit all my P60s for 5 years and additional payslips (so the UKBA could establish that I had indeed acquired PR), my husband's Swiss passport, his PR card, his P60s for 6 years and his naturalisation certificate.
So my application first had to be decided under EU law = PR and then under AN 6(2) = as the spouse of a British national.
Hope this helps anyone else in a similar position.
Spike, why not use the NCS service? The agents are expected to be well versed in both EU and UK nationality law and when in doubt have a hotline to the UKBA caseworkers to verify under what section of law an application can be lodged and if all requirements are met. I have received my PR based on 5 years relationship but I'm not waiting for 1 year over PR as they took 13 months to issue my PR, now on that bases(EEA law) I'm eligible for BC but I'm planing to pay a lawyer to submit my application to cover all the explaining and in case of refuse and appeal, she would do it all.
Thanks for your great advice, I rather not to pay a lawyer(£400) but my problem is, not all the HO case worker know the rules, I was refused for PR by mistake and took HO 13 months with apology and issued me PR. Also, if you have strong evidence of your automatic acquisition of PR as well as 6 years of continuos residence in the UK (one under PR), then your application should be pretty straightforward I feel.
They can take a little while to debit the fees (a week or so). They will write to you to acknowledge the receipt of your application. If there are issues with the payment, they will also let you know in writing. They work on Saturdays and Sundays I believe, as they debited my payment on a Saturday and the acknowledgement letter was dated as Sunday!kasturi75 wrote:Dear all,

Congratulation on receiving BC, I have question, according to your time line you never received ack letter, I have applied on 13 March but haven't received any ack from home, money was gone 19.
