flr granted!!.but a bit confused still.

Post by taribo » Thu Apr 11, 2013 11:37 am

hi brothers and sisters.
i have just been granted 2.5 flr
i initially applied on flr 0 for the 10 years family route.
but then letter says i am granted 30 months and will
be eligible for settlement after a continious period of
60 months/5 years in the uk...just doesnt add up??
Can someone shed some light on this please?

and also i thank all the members and moderators in
this forum.their help has been unvaluable and i
didnt even need a lawyer to file my application.

You've been granted a visa under the new rules. Initially 2.5 years (30 months) and then you'll need to apply for a further 2.5 years to complete 5 years (60 months)...after which you can apply for ILR.

Wait until you get the BRP to see whether you have been put on the 5 year route instead of the 10 year path.

I believe that it's an administrative error.

This the decision letter.

dear mr...

[·····] consideration has been given under the immigration rules appendix fm paragraph R-LTR.1.1 (a),(b)and (c) requirements for limited leave to remain as a partner.
we are satisfied from the information you have provided that you meet these requirements and you have been granted leave within the immigration rules D-LTRP 1.1
Of appendix fm.

[·····] we have endorsed your biometric resident permit with limited leave to remain in the uk initially for 30 months.in order to qualify for settlement you must have completed a continious period of at leat 60 months in the uk with limited leave granted
because of your family life.
[·····] if your circumstances remain the same, following a continious period of lawful leave remain in the uk for five years and subject to meeting the requirements of the immigration rules at the time, you may apply for indefinite leave to remain[···]·

The letter couldnt be clearer.anyway lets wait for the brp as this could
Incredibly be the proof that some ecm are still using their discretion on
Family cases.
a quick background:
I was on a valid student visa.
my wife and 2 kids are british citizens
we are both employed and just about meet the 18600 rule.
(I am not even sure).

BUT:
- my wife only had four payslips,no employment contract and no p60.
-we didnt submit any house report at all, just a mere tenancy agreement with the council
-most of the joint bank statements we submitted were on the negative.

those are reasons we applied on the flr o initially.

I think they've considered you under R-LTRP.1.1.(d) - which includes EX1 as a requirement.

That could then include the wife (if there were insurmountable objects to her departing) or the kids (if they are over 7).

Providing you trip EX1 - then the rest of the financial requirements don't apply.
