Hi,

Could anyone one please advice on below:

We are (my wife and two children) are living in the uk since 2003,planning to apply for ILR but confused a bit.

1. Are we need to apply each one alone on seperate application?

2.My daughter's visa will run on 10/06/2013 (tier two dependent visa on my wife) , she has born her on 2007 but did not complete ten years yet, what we can do for her ?

Just to make sure i 'v understood very well,

1.We will apply for ILR for ourselves,then apply for visa extension for my daughter(as her visa will expire before we got our ILR) .

2.Once ILR approved , we will apply for my daughter an application for Registration as British for child born-in-the-UK .

Is that right please ?

UK-born daughter may apply for SET(F) at the same time as you (stating that parents' Long Residence application is pending) or (perhaps better?) she may skip applying for leave to remain.

Than you very much.

I will tell you the story completely, my daughter was born on December 2007 , her visa dependent on my wife's student visa, then on 2010 become Tier 2 (as my wife finished her study and got a job). I meant my daughter has applied for visa before (I think two times) and not like other cases in this forum: a child born here but did not have any visa status before.

Is that something different when a UK bon child who applied for a visa before and currently on Tier 2 visa, still is eligible to apply for SET (F) at the same time as parents' Long Residence application is pending?

Could you please also explain what you meant by "or (perhaps better?) she may skip applying for leave to remain"

Child's entitlement to British citizenship is not dependent on child's immigration status, if child is born in the UK. It's dependent on a parent being granted ILR.

If both parents are not granted ILR, then child's SET(F) will fail anyway. However, if a parent is granted ILR, then the UK-born child is entitled to register for British citizenship, irrespective of child's immigration status. So, there may be little point in the UK-born child making a leave to remain application.

Hello,

1) please apply your ILR using Form Set (LR)
2) Send your application and your wife's application together in one envelope, if your wife qualifies for the 10yr Long Residence.
3) for your children application, just wait till you get your application reference number for your ILR then apply for your children's British Registration quoting your ILR reference from Home Office.

Hello, please be specific with your question about **section 2** because it appears you are wanting to send two different (1)-Form LR & (2)-Form MN1, applications to HO.

If it is Form MN1, you mean the date you were given ILR, it is a clear question, since you are applying for your child on form MN1 , it's assumed you have already be given or obtained ILR or in the process of obtaining ILR, so just fill in the date on your ILR-BRP Card or if it has been stamped on your passport. Otherwise just wait till you get your ILR application reference number from HO, then fill it in on Form MN1 for your child/children.

Thanks for that. Yes , i meant form MN1 which i need to fill for my daughter after submitting my Form LR .

So after submtting my Form LR on 26/07/2013 and getting reference number within few days ( hopefully) and before my daughter's visa expires on 10/09/2013 , i will submitt MN1 application.

You should wait until you are granted ILR before submitting the MN1 form for your daughter. It may be refused if you don't have ILR at the time of the consideration.

Having re-read the guidance, that may also be possible (8.5.5). However, what would be the advantages in her applying for MN1 before you are granted ILR?

A friend has confused me about which form i need to apply under 10 years resident so please advice:

1.my current visa is under work permit(from 2009) up to 03/2014 but i will be able to apply under 10 years resident on 07/2013 because iam here since 08/2003.

2.My wife and childern visa are under Tier 2 (General) , they will also be able to apply under 10 years resident on 07/2013 because they are here since 08/2003.

3.can we apply in person?

Hi everyone,

I got one more question :

I was on student dependent visa since 08/2003 to 02/2010 and then got a work permit before my current visa expire, but according to home office , i had to leave uk and get entry cleareness .

1.My visa was up to 02/2010

2.But i moved out of uk on 09/2009 to get entry clearness.
3.After 9 days i back to uk with my new visa.

Can i still able to apply for 10 years ILR?

Hi,

I will apply for IRL soon, so I need help in these questions:

1.I have two passports with all stamps on it (there are arrivals stamps only but no departures!! ) and I will send my passports only but no any other documents , is that right or I need any other document just in case they need more evidence?

2.If I only send my passports, do I need to fill and sign section 5 – consent for UK agency……(page 20).

3.My son (under 18 years) also applying for IRL , do I need to fill my name and signature in section 6 – Declarations (page 22) instead of my son or I just need to sign but put his name?
