Hi

I got my ILR on 5year (hsmp+tier 1) in Aug 2012

My wife and son also got ILR with me - but they are living abroad since nearly 2 years.

I am living in the UK and I'm well within my days limit for BC.

When i apply for my BC can I apply for my 9 year old son as well (he's born abroad) - he doesnt meet the residence creteria - he's been out all the time).

I did read somewhere that children below 10, who are applying under section 3(1) do not need to full-fill the residence creteria?

Could a senior member kindly comment.
