Post by amjadleeds » Sat Apr 13, 2013 10:58 pm

Hi everyone,

my application for ILR is under process , I applied for my family through solicitor on FLR O form four weeks ago, still we havn't received any letter. My application been delivered to HO on 15th March, through my solicitor.
My question I want to call them to inquiry about Acknowledgement, can I call them if application was send through solicitor, second on which number I have to call for this enquiry.
Other i made bank draft for payment so my account debit as i made bank draft so cant check via they received payment.
Any one have same sort of experience not received acknowledgement letter after application date four week.

Your views/ advice will be great.

28 days rule

I think this just a myth. My personal suggestion would be to email UKBApublicenquiries@UKBA.gsi.gov.uk and request details regarding this switching within 28 days rule. I'd suggest you to see if you can succeed to get your partner's SET(M) at a PEO. However if you cannot and you get a positive response to your email, then I would say just wait until September and make a SET(LR)application in her own right which is far less complicated than FLR (M)/SET(M).

Thanks everyone for keeping me awake (sarcasm) all these 8 months.

enjoy the wait folks...I will still visit this thread and FLR(m) thread until my wife's app is approved

i heard from another member that you don't need to send brp again, as dependent application is linked to main applicant, and they will get their visa decided once their main applicant gets the decision.

Can they both now get ILR STRAIGHTAWAY. Senior members please help
Yes, you can vary their applications and pay the excess amount. You should get a refund for your FLR(O) if they take full payment for your dependants SET(M).

10 years long residence SET (O) applications

Post by nanmoom » Sun Apr 14, 2013 8:10 am

Hi All,

Its great catching up with all the ridiculous waiting time and complaints. I think i am right to say that we are paying exorbitant fees and should receive a better service. Each time one makes an application there are checks and therefore 10 years of checks have been conducted on those who have remained here . Evidence from my HO file which i received. What are we doing with the complaints and time limits we document on sky drive? Any action to be taken? This is frustrating and concerning . I also not that the petition (http://www.tntmagazine.com/news/london/ ... a-services) has been signed by 176 people surely there are more people being failed by the service provided by HO. Thanks

Ok, thanks once again man. You're a legend by the way! Will try and write them.

Never heard of SET(LR) though, is that a new form for long residence instead of SET(O)?

Thing about waiting till Septemer is that my wife is dying to go back home to see her folks. We've been planning this since last October. Her dad is starting to get a bit senile and she wants to take the baby and spend a couple of months there to relax after a pretty much full on year... Might just try set(m) at PEO and if that doesn't work, will just get FLR(M) and then go for SET.

Cheers

10 years long residence SET (O) application

I remember last year in december Mr Hello32 went to the PEO to get his wife's FLR (M) to which the case worker suggested to apply for SET(M) once she crosses her qualifiying period as she had enough leave to qualify for ILR. Because that was the first time ever such thing happened even some gurus on this forum thought the case worker was wrong.

Recently, we had a similar case of Mr Punjabis who managed to get his wife's ILR with FLR (M) and now I had an almost first hand news from my best friend that, one can go for ILR without FLR (M) provided, they have enough leave and had completed their 2yrs qualifying period.

( The information above seems to the approach now. This is quite helpful thank you). However , i am concerned with the time limit for the 10 year application which i have mentioned in an earlier post today. I note the application form has changed.

On another matter , i could apply under the 10 year rule which does not include my spouse now! However, i am currently on the old work permit which expires in December 2013.

In April 2008 , i successfully obtained an International Graduate Scheme which expired in 28.2.09. This was overlapped with obtaining a old WP on 22.12.08 which my husband is a defendant but arrived in the country in March 2011. We have been married for 2 years 9 months.

Q1. Its been 5 years including the IGS therefore could i apply under WP route for settlement. I am concerned with the waiting time for the 10 year rule which might take me to 8 months wait i am guessing. The possible pressure from employer in relation to a fixed term contract as a social worker.

Q2. If i meet the requirements could i include my husband as a dependant.

A response will be useful.

Since they are in this country for quiet a while on tier 1 general they shouldn't be affected with the recent changes. As there is no thumb rule maintained at the ukba with regards to whether they can go for set(m) directly without switching to flr(m). You can try your luck at a PEO for set(m) without switching to flr(m). Provided you make their application in June 2013.

In that case I don't see any other option but FLR(M). Get this done at a PEO and once you come back from India, you can apply for SET(M) in June this year. As they wouldn't qualify for SET(M) within 1 or 2 weeks under the new 6th April rules because they were under PSW dependant visa prior to June 2011.

Does the word gap means out of visa? If so, then its 28 days. Please read Long Residence and Private Life from page 20 onwards. [Amended]

IGS/PSW doesn't count towards settlement qualifying period. So, I am sorry but its a NO. However, I see that you qualify for ILR through your WP in December this year. You can include your dependents via this route. If you opt to go through 10 LR then you will have to apply for a FLR(M) for your dependents.

Hi Damanisshalo its bit confusing i believe time spent on IGS/PSW does counts towards 10 years long residency one of my friend recently got his ILR approved the last 2 years he was on PSW .
Do you mean to say it doesn't count for completing 5 years on WP or Hsmp /T1 General ILR route ?

today i was reading another forum where actually a solicitor replied to the question ( he said time spend on PSW does not count toward 10 years long residency ) i was shocked as i saw a proven example of approval .

The OP was asking if he can qualify for ILR under WP including IGS. Since IGS is not counted towards settlement, he cannot qualify under WP. He will have to complete his 5 Years under WP or any economical route. WRT 10 yrs LR, the solicitor in your mentioned forum is wrong. IGS/PSW/Student visa can be counted towards 10 yrs LR qualifying period.
