Urgent Help Required

Hi Guys,

I am just new to this form just need some help. My visa has been refused by DOJ reason is below.

My wife was working for only 3 years in the state not 5 years.

But I have been working in the sate for last 11 years with out a break No social claimed.

We are now separated after 5 years of marriage yet not divorced. My visa is expired for last one year, DOJ only granted me for month and half durning is whole process which is now up. My Naturalisation is in final process. Can you please help me in the sense that would it effect my naturalisation application and what are the options to get the visa?

what visa did you have for 5 years ? Was it stamp 4 eufam ? and what visa was refused now ??

I had EUFAM 4, I filled the EU form 3 to renew my visa. Since my wife is separated for last one year, prior to this when we were to gather 5 years and she worked for only 3 years so they refused the visa based on that my wife was not working for 5 years. what are my options ?

was you granted retention of a resident card (form EU5). I sent them form eu3 too 2 weeks ago and waiting for thier reply , when my 5 years stamp4 eufam expired in 2011 I got another 5 years visa from Garda station , I still have stamp 4 EUfam valid for 3 more years and applied for Citizenship as well about a year ago.
I spoke to the Immigration officer about citizenship matter and she told me that if you dont have permanent resident card your application for Naturalisation will not be approved thats why I applied for it.

if you dont have any visa at the moment or due to expire your application for naturalisation is more likely to be refused. but dont loose hope their must be another way coz you have been living and working here for long time.

can I please ask you something. how long did they take to decide your form EU3 application and after how long did they send you your passport back ?

Hello ! I know one Case happened with my friend ... He applied for Naturalization on Behalf of 5 years Residency EUFAM4 and Also applied EU3 PR application ... On Some Basis That he wife was not excercising her Eu Treaty Rights They Refused his EU3 Application But On the Other Hand He recieved Approval of His Naturalization :) So that is the Case i Personally know with one of my Friend !!

i think you need to contact a good immigration solicitor ASAP , the Immigration office will make it look like you don't have any rights for renewal of your Residency , but am sure it is not your fault that your wife ceased employment before the 5yrs timeline , also you mentioned that you are seperated , a Good immigration solicitor will try to get you residency on your own merit even if it is a temporary one , so you can pursue your Naturalisation process . another alternative you can still email Solveit , they might give you some information . don't rely on what the immigraiton office said , they are known for breaking the immigration laws and try to find any excuse not to renew someone's residency .

What would have happened if you claim social welfare? Is it illegal or bad character to claim?

May I ask why you were here for 11 years and just recently applied for naturalisation? Since you keep proclaiming you have no criminal record, never received social welfare etc. what was the reason behind your late application as your citizenship application should have been granted years ago should you have applied

i was student for 1st 5 years, as soon as i was eligible i applied for naturalisation.

Well you must count yourself lucky since you said that your naturalisation application is in the final process, which means that all investigations have been done about you and INIS isnt looking for anything further with you.

Your naturalisation application is either has been decided or in queue to be decided and nothing more that you've said will affect it whatsoever.
