Tier 2 application While Tier 1 is under appeal

Hi
Can someone suggest me.
I applied for Tier 1 entrepreneur on 19th october 2013 and my psw leave expired on 21st october.
I got the rejection on 4th April and i made in time appeal.
now my company has got sponsor license and they are ready to sponsor me and my job title and salary requirements are also meeting with ukba guidance.
Can I apply for the Tier 1 general and do I have a strong chance. I have tried reading section 3C and 3D but could not understand much.
