confused and need help with irl

hi my husband is from morocco were in the prosses of trying to gather everything we need to do his irl in august when his spouse visa runs out but im needing some help and advice.
his passport that has his current visa stamped inside it runs out in june and hes applied for a new one but they want the old one back when he receives the new one what will happen with the visa and if its taken in the old passport will this course any trouble? and also hes been told that the first half of the certificate for his esol entry level 3 english with citizenship course that he can apply with only 1 half of them before hes finished the course is this true or is he being told lies

Morocco is weird in that they take the old passport and do not return it to the holder. Normal practice in other countries is to give it back so that you have both to show to UKBA.

In this case, you cannot be expected to provide something that has been legally retained by a foreign government. I'd suggest you make good colour photocopies of his current vignette and details page before returning it and include this in your application along with an explanation of the facts and obviously the new passport. What they really need is the reference number on the vignette to find it on their database. Section 11 of SET(M) does state that you should provide "Your current passport or travel document. If you last entered the UK on a previous passport or travel document, please also provide this document if you have it". It will cause you trouble if he left the UK....re-entry would be granted on a discretionary basis (irregular proofs). Shouldnt be a problem staying put as there is only a short gap. You can also apply on form TOC (transfer of conditions) but its not free and not expedient either unless through PEO.

Please see section 22 L to M of the SET(M) guide in answer to your second question. Make sure the college is properly accredited before accepting any guidance they offer and even then, make sure its coming from an appropriate person - a senior college official as opposed to a receptionist.
