ILR and passport for UK Born Kids

We have decided not to apply for ILR for our uk born kids(That already have dependent visa from home office to travel outside the country). But the solicitor is of the opinion that as valid visa for kids is not a requirement for registration of uk born kids, once eventually one of the parents got an ilr.
you may not encounter any problem for registration but at the time of acquiring british passport UKBA may check the history of overstaying and in such a case it is on their discretion to issue a passport or not or they will take long time to decide to give UK passport 2 years or 3 years.
Does anyone have a knowledge about it we still have our kids valid visa upto 7th of May 2013.Your quick response will be highly appreciated

your kids can skip ilr as they are born in the uk their registration once a parent hasikr is one of entitlement under section 1(3) and wont be classed as overstayer by ukba when you apply for registration.

also, it is not the ukba who issue passports, its the IPS and i have never heard of a passport application taking 2/3 years!

Yes, the child might be classified as overstayer but that status will have no impact on registration application for a UK born child.

When IPS issue a passport, they are not concerned with past immigration status of the applicant. All that matters is that the applicant can prove he is British.
