Question about my status

Me and my boyfriend are both undocumented since 2007. We are both Non-EU came here as a tourist for 3 months than overstay our visa. He got me pregnant in 2009 the child is now 3 years old. My questions are... 1) Are we entilted to Zambrano 2) Can we get deported even if we got a child here?

You are nowhere close to be entitled to a Zambrano Case. Your child is not even Irish! nor is S/he entitled to an Irish Citizenship.

Having a child in Ireland does not mean that S/he is entitled to an Irish Citizenship, and in your case, your child is not Irish.

Yes, yourself, partner and your child will be deported when caught/controlled by the Gardai or the Immigration Unit .

Note: For your child to be entitled to Irish Citizenship, you must be living here legally for 3 years. This is when you can apply for Zambrano if this was your case.

A child born in Ireland before 2005 became an Irish citizen. Your child was born after 2005, and so is not an Irish citizen. Therefore Zambrano does not apply. The child does not protect you from being deported.

As stated by another poster, you need to be legally resident for a number of years in order for your child to gain citizenship (since 2005)
