traveling from germany to france then to ireland under direc

Post by sarahpoole » Fri May 10, 2013 11:20 am

Hi
my husband is in germany and we now wish to go to ireland via france.
we are going to apply for a visa at the irish embassy. my husband is not allowed to enter the united kingdom because of a deportation order. will this likely affect his visa. under the directive2004/38/ec.
he is not a threat to the public safety, health etc as he gained a schengen visa to germany.
he has stayed past his 3 months in germany because we had passport difficulties will this cause any problem?
as for traveling to france first we are likely to either take train or a car lift from carpooling.com from germany to france, if i travel with him i hoping this will not cause any problem with our marriage paper etc

thanks for any reading and any input

The UK order should not affect freedom of movement to other EU countries as long as you say not a threat, etc, etc.

Thanks eusmile for your reply.
So when he gained his schengen visa he wasn't on the sis or anything like this.
So I assume its the same situation with the irish visa.
Will the problem of being in germany over the 3 months be any problem?

Can they refuse a visa because of a deportation order.
The visa form asks about previous deportion order and we are going to be honest on the form.

It would depend on the reason for the order. You state "he is not a threat to the public safety, health etc", so should be fine.

the irish are likely to find out about the deportation order as they share immigration history with the uk,so no need to hide it if they ask u about it,but to be honest i don't know how u are going to apply for the visa to ireland,is it from france??do u have residency there?i'm not sure if u v=can just walk in the embassy and ask for a visa to ireland..!!!is it what u intend to do?

We are not planning on hiding it. We just want to know how it will affect it. He wasn't a threat when he applied for schengen visa so I was wondering if will be the same.
We are going to ireland via france. So we have to travel to germany with no valid schengen visa just a irish visa. And catch ferry from france.
You don't need to be a resisdent iv already had confirmation from the irish embassy.
