When can my friend apply for her ILR?

When can my friend apply for her ILR?

Hello every one

My friend came to UK in October 2012 with her spouse visa(her husband is English). Her visa was granted in September 2012 and will expire in 2 years. When can she apply for her ILR? In 2 years or 5 years time?

In July 2012 ukba had changed the qualifying period of spouse visa towards ILR from 2 years to 5 years. Therefore, she will need extension of visa.

When did she apply for the visa? Prima facie it appears to be under the old rules, and she will be eligible for ILR after 2 years of probationary period in the uk.

The rules changed in July meaning that current applicants have to spend 5 years with leave to remain before they're eligible for settlement, so yes, it's important to know whether they are under the old or new rules.
