Need help to know whether to applyOCI or POI for my daughter

Need help to know whether to applyOCI or POI for my daughter

Dear Friends,

I am currently on ILR and my wife is in Tier 1 dependant. My daughter is having her UK passport now. I am planning to apply for her OCI.

But not sure whether to apply OCI or POI for her.
The reason for my confusion is
- She had an indian passport/uk visa stamped and used for travelling purposes. I surrendered that passport and got the Surrender certificate. So she was a registered indian. Based on that shall I proceed for her OCI?

Or Since Parents both are still in Indian passport, I need to apply POI for her. forgetting the fact she had an indian passport by origin.

Could you clarify me on which option I should go?

P.S : My daughter is just 1yr by now.

If you have your daughter's Indian Passport Surrender Certificate, then she qualifies for OCI, so apply for OCI.

To me you baby is only eligible for PIO card, if you want her OCI one of the parent needs apply for OCI along with her.
Rules are changed by Prime Minister of India.

You need to apply for PIO card as the child is not eligible for OCI yet (as both of you hold Indian passport).

but the only statement that creates confusion is

- or was a citizen of India on or at any time after January 26, 1950,

Since she acquired indian citizenship. Shouldnt be eligible for OCI.

That statement is applicable to an adult applicant only. If you read the full paragraph on eligibility, you'll find the following statement - Minor children of such person are also eligible for OCI.
