More questions regarding EEA Family form...

Post by canuckUK » Tue May 14, 2013 4:42 am

I'm unsure of how I should answer some questions in the VAF5 form.

How long do you intend to stay in the UK
What am I supposed to put here if I don't know how long I'll stay?

Where do you plan to live in the UK
My EEA National sponsor will be travelling with me and we'll be renting, but don't know where yet. What do I write if I don’t know the exact address?

The guide to supporting evidence suggests I send evidence of current employment
First, is that necessary or is that one of the questions that don't need answering? If necessary, would payslips be enough or is letter from employer really the way to go, even if I’ll resign before actually moving to the UK?

Valid from date
Can I specify a valid from date? Or is the valid from date ALWAYS going to be whenever they issue the visa?

Supporting documents
Also, do I need to provide translation of ALL documents provided? For example: bank statement, payslips, etc...

Thanks

Are you married to the EU citizen? What is their citizenship? Are you Canadian?

Many of the questions on the form do not ever need to be answered

Directive/2004/38/EC, why not? This is not an application for a Schengen visa.

I can answer from several perspectives.

One is that the visa can not be refused if you do not answer:
how much the EU citizen made
how much the non EU made
assets
Where they were working
Where they plan to live in the UK
Whether they have previously had a residence document from another EU country
Which colour you prefer on south facing walls

None of these lead to one of the three possible grounds for refusing the application (public policy, public security, public health).

Another take on it is http://eumovement.wordpress.com/2012/11 ... questions/

I am Canadian.
Partner is from Portugal.
Not married, so would be applying as unmarried partners.

For example, for the question where do you plan to live: assuming at time of application we don't have an exact address to provide, is it better to :
- not answer
- be vague (ex: London)
- be vague with a reason (ex: London, will be renting but blah blah blah...)
- or just write : unknown or N/A

Where you are going to live is one of the questions which is not relevant. Just answer "do not know"

If you were married you would not even need to apply for an EEA FP.

Note that all you need to prove is that you are long term partners. Questions of how much each of your earns are not relevant and can be ignored. As can questions of what either of you will do in the UK.

If there is anything that you are unsure of or do not yet know the answer to, you could explain this in a covering letter.

canuckUK, In my opinion Directive is right all about legal side of it, but in practice you may want to think what you really want to do.

My suggestion is , let your application form looks like you are both going there for a visit, because in reality once you are there you are entitled to change your mind about your intentions.

do not answer that you intend to live or work in UK, you need to specify how long you will be there, so maybe answer 1 month or something like that.

Pablito, I realize you are not suggesting it, but I will use this chance to say: It is important never to lie on an immigration form.

On the other hand, realistically one moves to a new country with the intent to check it out. If it works out well you stay, and if not you leave and do something different.

Yeah, I'm not too sure about not being 100% honest about my intentions when dealing with immigration matters. I did that one at the border, and it kind of backfired on me, fortunately without consequences...

What about the valid from date.?
Is that something you have control over or is the visa going to be valid whenever they send it.?
Does specifying a travel date have any impact on the valid from date of the visa.?

Thanks.

Canuck, you don't have to answer question about your main reason to travel to UK, from here follows that whether its vacation or finding a job, you have entitlement to change your mind, so if they ask you whether you intend to work in UK and you answer "no" still you would be entitled to change your mind once you are in UK.
