ILR or visa-extension query for dependent (wife)

All,

I am currently on Tier-1 (General) visa in the UK. And in Jan 2013, I have applied for my ILR visa on basis of being in the UK for 10 years. And hoping that will get positive result by June.

Wife is living with me in the UK for more than 2 years, on Tier 1 dependent status. And her current visa expires in 2015.

But questions come to mind:
- Will her current 'Tier 1 Dependent (General)' visa stay valid if I get ILR?
- If not, for which visa she will have to apply?
- And if we have to apply - in how many days after I get my ILR?

But some questions remained unanswered as I don't know much about FLR(M)..

Assuming that this is not as same as ILR... So...

But questions come to mind:
- In how many days we have to apply after I get my ILR?
- What will be the visa-duration? And when she will be able to apply for ILR?
- And also that, how long will be the waiting time for this 'application for extension of stay' application? Hope that not another 6+ months![/list]

If I understand it right - she can directly apply for ILR? [SET(O)]

Not if you applied for ILR under long residency. She will need to apply FLR(M). The thread you have quoted, ILR was granted on WP+T2+T1 in which case SET(O) would have been correct.

as soon as you get your ilr

2 years if your partner with pre july 2012 rules, or its 5 years i assume

Thanks Vinny! I see following point mentioned in that topic.
Dependant eligible for settlement under long residence on their own merit: If a dependant qualifies for settlement under long residence on his own merit before expiry of current leave, then also there is no need to switch to FLR(M).
Now she has been with me in the UK on PBS Tier 1 General Dependent visa for more than two years.
Does it mean that she qualifies for ILR after I get ILR? And she can apply for ILR straight away.. instead of FLR(M)?

BTW, her current leave to remain (Tier 1 Dependent) expires in 2015.

1. Can somebody suggest what documents we have to submit?

2. Also that - about english language requirement.. will it be okay if just show her bachelors' degree-certificate from India (that is in English)? Or she will have to give any English exam? If so, can she just give Life In UK test?

3. By when do we have to apply for her FLR M application? (Her current Tier 1 dependent visa expires in 2015)

I had a look at this again - and it seems that she can directly apply for SET(M)... on basis of clause 287(a)(i)(d).

Wifey entered UK after getting my dependent (PBS tier 1) from India. Initially about 2 years visa - till my visa expiry date.
She has then also extended her last year as dependent (PBS tier 1). Got visa for more 3 years (till 2015).
She has also been in the UK for 2+ years.

So, I think that we can apply for SET(M) straight away and save some money?

You need to apply for flr(m) and then when you qualify, set(m), which could be immediately after flr(m) is granted.
