Switch from tier 4 to Tier 2

Hi, I have applied for Tier 4 extension in December 12 and as at today 22/05 has not received the decision. Biometrics was given in January.Called UKBA last week - they say application is in progress.I have not finished the 5year limit as well. Unfortunately my college licence got suspended 2 week ago .My problem is now I want to submit a Tier 2 application. I have a sponsor already willing to issue COS. Can i submit the Tier 2 application or should I have to wait for Tier 4 desision to come?

If your tier 4 application is still in progress (undecided) then you cannot send fresh application rather can vary the grounds of existing application.

So cannot send a Tier 2 application?But due to college licence being suspended now will I get refused?appeal?or 60 days?

If your college licence is revoked. Then most probably you will get 60 days to find new licensed institute for study or otherwise leave the country within this time.

I think firstly you need to sort out your tier 4 application instead of mixing up with tier 2. The following UKBA guidance can be helpful:

Well i cant really do anything about the Tier 4 application - its beyond my control now. I think i will be better off thinking what to do next if anything good or bad happens

You cannot switch from Tier 4 to Tier 2, as you have not graduated yet ...

Only PhD student are allowed to switch to Tier 2 if they finish 12 months towards their study. Even if you were a PhD student, you won't be able switch to Tier 2 because your Tier 4 sponsor license has been revoked.

I have graduated already and all my paper works are in line to apply for Tier 2.

I was thinking the same, got to ask employer to do labour resident test. The college is now suspended not revoked and they are appealing now.
