HSMP may or may not lead to ILR. Employers will be very relectuant in hiring people with HSMP permits with ever changing rules and more changes to follow.



The United Kingdom's Immigration Minister, Liam Byrne, announced a timetable for the country's new points-based immigration system during a visit to Australia, which uses as similar system.

"Migration has to support Britain's national interests," he said, later adding that the government wanted more robust control of borders but "not a barricade."

The new UK system was first announced by Home Secretary John Reid last year and has had several key features already integrated into immigration policies and legislation. The Highly Skilled Migrant Programme (HSMP) already uses a points-based evaluation system.

Applicants under the new system would need to gain a sufficient number of points. Scoring is based upon a balance between the skills of the applicant and skills needed in the UK, as determined by government research and statistics. It is designed to replace more than 80 different routes of entry into the country with a five-tier structure split into different skill levels.

The first tier will become effective from the beginning of 2008 and will be for highly skilled migrants including scientists, doctors, and entrepreneurs. Migrants entering the UK under this tier will not need a job offer.

The following year the second tier will become effective, covering skilled workers such as nurses, teachers and engineers who have job offers in shortage areas.

Tier three will cover low-skilled workers such as one-contract construction workers and catering staff. Migrants in this category will require an employer to sponsor them.

Tier four for students will follow at the beginning of 2009. Students covered under this tier are those paying tuition in the UK. A system of sponsorship by employers and educational institutions to ensure compliance with the immigration rules is being introduced at the beginning of next year.

Tier five will include working holiday makers as well as professional athletes and musicians.

The exact timetable for the new system will be introduced over the course of 2008 - 2009. The first tier for highly skilled migrants will be introduced in early 2008. Following later in the year will be the second, third, and fifth tiers. The tier for students will be introduced in the beginning of 2009.

Why to fear when already taken plunge into dream world called HSMP.

Wait till 2008. Let see if people for hsmp extension can get over further extensions under new rules. My main fear is that these rules may make difference in occupation category. So even if person is earning more than required to claim points in salary. His occupation category if deemed classified as with no shortage of local people, may put people in situation of not getting further extension. Lets see what are in rules

We should think twice before availing this glittering opportunity because all that glitters is not always a gold. Just a suggestion to all , do avail the opportunity but don't burn your all boats !!!

The leaflet on the Home office site points to old HSMP Scheme..

So will be HSMP Scheme Version 2.00??So existing HSMP might be scrapped?
OR the Goverment doesnt know (!!!) that such points based scheme is already in place and it is called HSMP..

Better all IT, computer , electrical, mechanical Engineers on HSMP start make plan to become "Enterprisers" now. Otherwise no HSMP extension (or TIER1 extension ) boss.
And it seems second HSMP extensions is a must before reaching a dream status called ILR. Since 90% hsmp people will be short of 5 year period ranging from (1 year to 2-3 months), even after have got “Firstâ€

You are 100% right. Another set of rules being prepared to be implemented in a retrospective fashion and being prepared in a fashion to take care of any remaining HSMP guys out here to go back.

I strongly feel that the HSMP permit should be issued initially for 5 years (time required for ILR) itself or the time for ILR be reduced to 2 years.

As per HSMP guidance:

"You must be willing and able to make the United Kingdom your main home

If you are successful in your HSMP application, and apply for leave to enter or remain, we will ask you to provide a written undertaking that you intend to make the UK your country of habitual residence".

HSMP should lead to ILR. Otherwise, the above mentioned does not hold true.

Highly Skilled Professionals consider a country an attractive place to move depending on how easily & quickly they can acquire Permanent Residency (Indefinite Leave to Remain - ILR in UK).

USA has lost its shine because of the very same reason (staying 6 years on employer sponsored work visa before being considered for Permanent Residency - aka the Green Card)

Permanent Jobs & Permanent Residency go hand in hand. HSMP visa/permit is temporary in nature, subject to renewal depending upon the rules existing at the given time.

Britain to follow Australia's immigration example

Britain will next year adopt an Australian-style model for restricting immigration to those with skills in need.

British Immigration Minister Liam Byrne unveiled the timetable for introducing the points-based system during a fact-finding visit to Australia, which uses a similar model to attract migrants with in-demand skills and reject those who would compete with local workers for unskilled jobs....

....Mr Byrne is attending an international conference on immigration issues in Sydney.
Australia grants Permanent Residency to skilled applicants that meet the criteria, unlike the wait & watch approach followed by UK.
