Concerns about Set(o) form questions -- Please help!!!

I am going to apply for my ILR next month (i.e. July 2013). I have bit long immigration history, which is given below

1. First entered in the UK in October 2002 on Student VISA

2. Switched to Work Permit in May 2006, (out country switching)

3. Left UK end of July 2007

4. Came back to UK on 4th August 2008 (new work permit)

5. Switched to Tier1(G) in May 2009

I am going to apply for ILR, second week of next month, based on WP + Tier1

I have few confusions about the following questions of Set(O) form,

[b]6.1 When did you (the main applicant) first enter the UK?[/b]

==> I believe this is straight forward, 4th August 2008

Now the confusing part for me is the question 7.11, i.e.

[b]7.11. How long have you lived in the UK?
Please provide details of any periods of absence of more than 6 months during that time.[/b]

==> What should I put here, 9 years 9 months or 4 years 11 months.


I would appreciate if some one could provide me with some expert advice.

Thanks dubeyv for your response. But r u sure that the question 7.11 refers only to the ILR eligibility period and not the entire immigration history.

Any suggestion from others?

I am dead sure about this as your immigration history would only count when you are applying under 10 years long history.. on that day if you are using SET O form all they would be interested in is either date of entry in Uk or Visa date by which you are eligible to apply for ILR... the more you explain.. the more they get confused and more the delay and more the search.. so keep it simple and straight.... Dont leave any open ended questions if you understand what I mean.. :)

Hello dubeyv,

I need one clarification please.
I am applying for ILR for my wife and kid who born in India. My 2nd kid is born here in UK in Mar, 2012 and in section 5.7 and 5.8, I am going to mention about that as well.

Can a case worker why are you not applying for kid ILR then? The answer I will give as "after my ILR I will apply for my other kid ILR" will it be OK?

I dont see this as a problem when your second kid is born in UK and you registering him or her as BC. I asked this question in related to some body and Vinny responded that one can get registered their child even if they are not applying along with the Primary applicant so I guess you should be fine.

Just to give more peace of mind, ask this question in general forum and seniors and gurus would pass their views as well....

By the way I have found this link which might instigate your thought process of why one should include UK born child in Set O, if he has every got dependant visa of the parents..
