Seperate ILR for Dependent Clarification - Urgent

Hi -
I have got ILR on 3rd May through WP+Tier 2 ICT and now I am applying ILR for my dependents. I have got an appointment 8th July.

My question are as follows -

1. Is there any issues in applying for dependent ILR on 8th July, they are with me in UK from last 4 years.
2. Is there any 28 days rule, not sure about that as my friend told me.
3. I am planning to resign from current company next week. will that cause any issue?
4. I am using SET(O) form for my dependent ILR, hope this is correct.

Note - My dependents have visa validity till Jan 2014.

Please let me know.

I assume your children were born outside the UK? Perhaps consider registering them as British Citizens once you are naturalised?

My kids are born in India.
I am worried, if any issue with my dependents (Wife + kids) ILR on 8th july.

Can any one clarify question 4, I want to double sure about the SET form. As I have ILR and my dependents are still in my Tier2 ICT dependents.

Can you clarify on 2 & 3 question. I am planning make my last in current employer after my dependents ILR appointment date.

I had got my ILR on 3rd May 13 through WP+Tier2 ICT and now I am planning to apply ILR for my dependents on 8th July 13.

Is there any such rule, that I should apply ILR for my dependents within 28 days of my ILR approval?

Note - My dependents have visa (Tier2 ICT Dependent) validity till Jan 2014.

As per page 32

From 9 July 2012, dependant partners of PBS migrants must complete a five year probationary period before they qualify for ILR. Where a PBS migrant obtains ILR or has become a British citizen before their partner has completed their five year probationary period, the partner may still apply for further leave to remain as a PBS dependant rather than as the partner of a person who has settled. If their application meets the requirements, leave to remain can be granted for up to three years.

so it's mean pbs dependent will be valid after main applicant ilr.

I am in same situation as yours and going for my wife's ILR on 6th June. I will tell the result.

Ishwarch,
There isn't any rule of applying for dependents within 28 days from youe ILR. You can very well apply anytime before their current leave to remain expires.
Also, yes SET O form is correct to use for your wife. You can include kids along with her in the same form as far as they are minor and your dependent.

Thanks for all these information, infact in next two months I would be in same situation, where I will get my ILR but my wife and kid would be on ICT dependent till Dec'13. I know that I can apply their ILR sometime in No-Dec, but what if I travel outside UK before that, Will that be a problem ? where I am on ILR and my dependents are on other category dependent Visa.

Hi Ishwarch,

My wife got the ILR without any problem. I got ILR in march 2013. My wife's tier-1 visa valid till may 2014.

I also asked question to caseworker that if my wife didn't apply for ILR today, can she travel . Caseworker said yes, she can travel, and till the validity of tier-1 dependend visa.


First I haven't given the bank statement and said that there is no requirement of mantinence fund, she agreed but said as normal practice she requires 3 month bank statement.

The only problem they have not given to my son as he born after I got ILR.

Thanks Vinny. But I got Indian passport for him and I don't want to apply British passport. I have to travel last week of this month. is it any other way he can come back uk other than right of abode.
