I think you should contact them to mention the additional information, they will find out anyways so it is best to make it clear that you werent trying to hide it.

Peterpan, I think it is always useless to try to contact UKBA for status update for any application which is within their service standard (6months), you can see a few examples when UKBA responded with standard blurp to state that they cant update you with status as applications could take up to 6 months

Dont worry about your application, I know it was submitted in April and you can see lots of approved folks, but different apps need various levels of checks... and the delay doest necessarily mean it is a negative outcome.. you have your ILR and in the worst case scenario you can reapply should your outcome is negative (but hopefully it will work out ok).

That's true but at least you would still know when to expect a response from UKBA whether approval or refusal.

And I wasn't aware they sometimes ignored the prepaid envelope. That would anger me if they did that, because they tell you to enclose a prepaid envelope if you want special delivery and you pay money for that prepaid envelope. How dare they not use it.

Good Character Requirement - Spent convictions

Hi

I have applied for Naturalisation in March 2013 and did not know that I have to declare spent conviction as per the new rule which apparently got introduced in January 2013 (Is this correct :?:) so I did not declare it

At the time of applying I checked the UKBA website which still says that I do not have to declare the spent conviction (see below links)

"If you have been convicted of a criminal offence you must declare your unspent convictions but do not need to declare ones that are spent. "

I received a conditional discharge in Feb 2009 for 12 months by a court for travelling on a train without a ticket. No fines were imposed as I was only ordered to pay the court cost and the cost of the ticket. The conviction became "spent" in Feb 2010 and since then I have brought my wife here to UK on Tier 1 General dependant and had my ILR in March 2012 and did not declare the "spent" conviction on both occasions

Is this going to be an issue as its been more than 2 months and I have not yet received anyting yet and the fee got deducted on 7th April

Please advise !! :?:

A friend of mine applied the 21/03/2013,got the acknowledgement dated the 30/03 and received the 6th of april,the fees were taken the 30/03 and since then he is waiting ..!!

Well no one in this forum can do anything about it. All you can do is request by letter to decide application quicker and attached your logic and documents why they should decide it quicker and then they can take it as a consideration if they want.

I'm in the same boat as you.

I'm wondering if the letter is lost in the mail or something or perhaps our applications haven't been decided as of yet. Could be anything I guess.

But I wonder what would happen in the case an invitation letter from the UKBA is lost in the post? We would not know its lost and the booking time for the ceremony may be lapsed.

I wish there was a better way UKBA inform applicants of the progress of their case...such as an 'online tracker' like the USCIS offers stateside.

u can try and call the council,they might have your certificate then there is no way of u knowing if your council usually expect u to call..!!some councils sends letters of invitation to people asking them to to confirm and book a ceremony date,so its worth maybe calling and check,i've read something like this happened to someone in this forum,he called by a chance and they told him they had his naturalization certificate and had to contact the ukba for a duplicate copy of the approval letter which he got later and booked his ceremony and went.

Thanks for the advice...I might try calling the council and check to see if they have my certificate just in case the letter got lost in the post.

The postman has recently been mis-delivering our post :x

I just checked with my council and they haven't received anything from the UKBA yet. They also said that they send reminder letters to applicants whose certificates are reaching close to the expiry date.

Thank you UKFOREVER for the advice on checking with the council just in case my letter was lost in the post.

Atleast now I know that my application is still under consideration and that the council has a back up system to contact applicants who have been approved.

So I've just checked my prepaid special delivery reference number in Royal Mail Track and Trace and it says it's on it's way! It will be delivered tomorrow. Fingers crossed it's an approval and I won't be disappointed. I will update you all tomorrow and in the timeline thread!

Hiya folks,

Quick Question:
If ILR was granted on the 10 years residence rule but the application was made on the 12th year of legal residence in the UK.
Do you think the discretion (quoted below) in Chapter 18 of the nationality instuction will be applicable for naturalisation?

Discretion to disregard immigration time restrictions in the final 12 months may normally be exercised if:

a. at the date of application, the applicant has had less than 12 months free of conditions but has been free of conditions for more than 12 months by the time the application is considered, provided the other requirements are met;

Android55; basically the 12 months free of conditions is calculated from the date the UKBA receive the application. The discretion you are referring to applies in situations when the application was received before completion of a 12 month period, but processing and determination occured at a date which is beyond the 12 month period, in such cases the caseworker has descretion to approve the application on the basis of the date of determination rather than the date of application which is short of the 12 month period.

As such, I dont think this discretion applies to your situation.

I don't think they would consider the fact that you were eligible for ILR 2 years prior to the date you have obtained your ILR.

May I ask, did you apply for ILR in year 10 and your case was resolved by year 12? or did you apply in year 12?

Applying for my first british passport after naturisation.someone at the post office told me that I need to send my mothers birth certificate. Do I need to send my mums birth certificate? Confused

I just received my approval letter! I was right in my estimates; it was approved on Tuesday, exactly a week after they received the further documents they asked for, just like what happened with some others who were also asked for further documents. So even though they asked for further info my approval was only really delayed by a week and a few extra days (the extra days were weekends and the bank holiday).

As I suspected, they were probably almost done with my application and only needed the documents to finish it off. My application was very straight forward, the only reason it was delayed was because I didn't know I needed to enclose those other documents with it. So don't forget documents guys! Check to make sure you've enclosed everything they need.

On my letter it says I have to wait for the ceremony letter and not contact the council. I'll try my luck and contact the council anyway. Haha. I'm very happy. It's such a relief! Very Happy

Need advice of applying Naturalisation

Hi All,

I came to uk on dependent visa 5 years ago. my husband is holding ILR since 2007 and he has not taken citizenship yet. now, i am planning to take British Citizenship and not him.

I have got ILR in Aug 2011 based on previous dependent visa.

My questions are:

1. Do I need to show P60 ( under settlement prood) for last 5 years? 3 years.

Below are details:
I was working for an indian company for the first year in last 5 years. I have got only payslips(soft copies). further 1 and half year i didn;t to any job. again since last 2 and half years I am working and i have P60 forms.

2. Do I have to be in UK on 5 years before same date as of application date? or it is 3 years?

Please reply. Please let me know if i have not posted this in correct thread.

This guy had requested information on the order in which applications are processed. The response he received from UKBA is in summary as follows:

"• Upon receipt of an application the form is date stamped and the fee is taken. A
paper file and an electronic record are then created and the file is ready for allocation
to a Casework team. Files are allocated in date order. All Nationality Casework
instructions can be found in the UKBA website by following the attached link

decision dependent on the necessity to request further information or documentation."

It is dated June 2011 but I doubt anything has changed since. If you really want to know, I would follow suit and request the information as per the author of that post referencing the access to information act.

hi,would u be little bit patient,please,i'm sure someone will be here shortly...i can't help u personally but i'm sure someone from the guru's or moderators would be around this time or little bit later,i imagine most of us here trying to help,have responsibilities/work commitments and we do help after we are back home and relaxed a little bit after a long day,then when we are rested and stress free,we can concentrate in giving the right advice for people,personally i can't help u as i have little knowledge of the particular case u are asking advice about,so,i hope someone will be soon here to advise u.
