were on a date falling within the three month immediatelyprior to the date of application.
1- registered with HM Revenue and customs as self employed or
2- registered as a new business win which he is a director or
3- register as a director of an existing business.
CaseWorker has explained it.
are working in an occupation which appears on the list of occupation skilled to National Qualification Framework level 4 or above, as stated in the code of practice in Appendix J and provides the specific evidence in paragraph 41 SD.
Working in this context means that the core service his business provides to its customers or clients involves the business delivering a service in an occupation at this level.it excludes any work involved in administration, marketing or web functions for the business.
Now my question is why the case worker have not checked that this job title is appeared in framework. which is 2423. and this this paragraph explains about mentioning that marketing web functions or bla bla. i am literally confused. need an expert advise please.
well i believe i have mention about sales and marketing in services to help the client to increase the chances of their business growth but if you are talking about contract or services then if this was the point then case worker might have mentioned it that your services and your job title doesn't match so i would say that case worker has only copy and pasted it and case worker was looking for level 4 but my degree comes up to level 6 which is bachelors degree. so this is the confusion i am going in to court so i want to be prepared about it. haven't received the date yet.KickAss wrote:sad.1 wrote:Refusal 1: for requirement you have stated your job title is ''Business Consultant'' This job title does not appear in the list of job titles that appear in Appendix J. therefore, you have not met the requirement.

Ok first of all 2423 is nfq level 6 and Business Consultant is a valid job title.
I assume case workers have a list of document from which they copy/paste the rejection reasons. So that it can be defended (Just Assumption )
But, the actual reason of refusal here could be that the services you are offering may not match the job title you have used as per case worker.
May I request you to quote exact services you offered in your website, advert or contract ?
This might give experts a better visibility to suggest you.
No I haven't mention any job title in advertisement contract or website I actually applied through lawyer and I believe that the advertisement I printed out was not mentioning my job title.KickAss wrote:Wait...
Did you mentioned any job title in advertisement, contract , website or any other place other than application form ?
If yes , what was it ?
Well by the time we applied I don't remember my lawyer fill up the form for me plus either this was not up or up the point is case worker mentioned it my job title is not on their framework, plus they have enquirer me in march so I have sent them my flyers and visiting cards flyers got all my name email address and office address and on visiting cards my name and my title was director on it. I don't think in appealrehan01 wrote:regarding reason for refusal : was your soc code at level 6 list when you submitted the application? also the services you are providing were level 6 services as per soc code?
regarding advert: my suggestion re advertise using different platforms ..... and make sure your advert must show ... .Your full name job title eg (Director / Business Consultant or whatever your title is), landline telephone number and company website address and contact email address ...... just to cover your up in appeal that you have re advertise with all this information.
also advertise as many places as u can like gumtree,yell.com,thomaslocal,qype, newspaper etc
all the best and good luck

First thing the refusal reason you mentioned states simply that caseworker overlooked your occupation in the Appendix J. It exists there and present Appendix J in front of judge in appeal. Thats it.sad.1 wrote:Refusal 1: for requirement you have stated your job title is ''Business Consultant'' This job title does not appear in the list of job titles that appear in Appendix J. therefore, you have not met the requirement.

Make sure you are not summarizing your refusal reason here because often people could not understand what caseworker try to explain. If you have summarized your refusal then as other fellows said, your services in contract are not inline with your occupation and definitely refusal wordings are not exactly same as you mentioned.
Second thing what caseworker tried to explain is nothing, its just about to refer guidance policy word by word and nothing more than copy paste.
