Hi everybody

I have applied from psw toTier 1 Ent visa in March and is still in process. I am still working with my employer as I can work until I get my Tier 1 Ent Visa. My employer has got their Tier 2 licence today and they would like to sponsor me and they also have a COS to issue to me.

My question is

would it be possible to apply for Tier 2 visa now, as my Tier 1 is still in process?

Could someone please help me on this urgently...

Hi Natesh,

You could probably withdraw your application and post a new one as long as you still have a valid visa to stay in the country. check this link for some info- http://www.ukba.homeoffice.gov.uk/sitec ... -documents

Hi there
You can vary your application send a tier 2 application with a covering letter explaining that u ve already applied under tier 1 this ll work as long as decision on application for tier 1 is not taken.

Couple more queries please

Once a variation application for Tier 2 is done before a decision on my intial Tier 1 application :

Is it up to the discretion of ukba to decide my application on either Tier 1 or Tier 2?

Or, they will have to decide my application based onTier 2

Provided you submit the application before the decision is given they ll vary ur application and a decision on tier 2 ll be given.
