if a child is born in Germany what status well he got?


father .EU citizen

mother .family member of EU citizen

If you are asking about citizenship: Likely the child will not get German citizenship at birth. But will likely get the citizenships of each of the parents.

If you are asking about right to reside: they will have the same right to reside as the EU citizen parent.

I have one more question I am eu citizen and I had lived and work in Germany for last 3 years now I am not working I would like to bring my parent from Iraq and I have little brother who are 13 years old is that directive/2004/38/ec well cover them? please I need your advice thank you so much.

and my parent my dad 56 years old and my mum 54 years old but she is disabled women.

You need to be exercising your treaty rights in Germany. That means either working, or being self sufficient.

If your parents are fully financially dependent on you, then you can bring them over.

And if you used to live with your brother, then he would also be covered (though the application may take longer then your parents).

Are they living in the Kurdish part of Iraq?

yes my parent live in Kurdistan north of Iraq.

Do your children have the right to live with you in Germany?

If yes, there may be a fast route for your brother - if you can legally adopt him he has all the rights of your child not the rights of your brother.

Not sure how this would work in Germany - it has worked in Ireland for a girl I know who adopted her niece when living in Ireland. The niece / adopted daughter was granted Irish citizenship in accordance with Irish law.

i have just found some info about adobtion in iraq.

Iraq does not permit international adoption
Despite the fact that Iraq is a country in conflict and thus correct procedures to safeguard the children are possibly not in place it does not allow adoption of its children by foreign nationals.


There is no adoption under Iraqi Law.
As of October 2005, there is only the system of guardianship which correlates to the Sharia Law of Kafala.
Iraq does not permit any international adoptions. They do no allow any foreigners to obtain legal guardianship of any Iraqi children.
If you are an Iraqi national living outside of Iraq and you are interested in adopting Iraqi orphans you will be deemed a foreigner and subjected to the same requirements as other foreigners. ie. you will not be allowed to adopt from Iraq.
The Iraqi Ministry of Labour and Social Affairs will only grant guardianship to extended family or friends who can provide for the child in Iraq. Therefore they only accommodate domestic guardianship.
A family will also not be able to obtain guardianship over a child of a different religious faith
