Need Help to fill section 6.1 of Immigration history

Post by ms2013 » Tue Jun 04, 2013 7:32 pm

Hi,

I need help in filling section 6.1 Immigration History of SET(O) form as I am applying for ILR.

My VISA EC date:- 08/07/2008
My First entry in UK :- 10/08/2008

Q in Set (O) form :- When did u first enter the UK? This refers to the date of your first entry into the UK at the beginning of the period of stay on which this application is based.

Will it be the EC date or the First Entry date, I am not sure as my application is based on EC date?

Cheers,
ms2013

Your First Entry date will be 10/08/2008. Don't confuse this date with your EC date.

Thanks Kevin for the reply however in the next line it says "on which the application is based"

I have booked my ILR appointment on 12/06/2013 based on the EC date 08/07/2008. Is this fine?

If your visa Expiry is on 08/07/2013 and if 12/06/2013 is 28 days before that date,You are fine.

Hi Kevin,

Is this an issue if my VISA is expiring on 19/08/2013 and I am applying ILR on 12/06/2013 i.e. 28 days before my EC date?

Hi Kevin,

I am bit confused now. What does 5th Anniversary date means?

The VISA stamping date i.e. EC date or the first entry date in the UK?

Cheers,

ms2013 - check page 21 of 31 of the following UKBA document, you should be fine with your EC date as long as you did not delay more than 90 days which you have already indicated that you haven't! For peace of mind, just read the entire document.

How did your application go - wishing it was a success so that you can be a free bird now with no immigration bounds!

My situation is slightly different and need your guys opinion on what should be filled.

For section 6.1, I was already in the UK on a student visa before my Work Permit was granted on the 19th August 2008. In this case, what will be the date of 'first' entry - would it be the last date I entered UK on the Student Visa which would be 1st August 2008 or would it be the first date I entered UK on the Student visa? The thing is, I was already in the UK even before my WP clock started so don't really see the point of this question!

Any ideas?

Thanks guys

Hi ms2013

How did your appointment go? I have a similar situation.. my initial Tier 1 General visa was granted from 25 August 2008 but I first entered in to UK on 10 October 2008. My current visa expires on 25 August 2013, so I am not sure if I need to go for another extension to complete 5 year period until 10 October 2013. Though the case worker guidance suggest that 90 days period is allowed if you take EC from outside UK and you have entered with in 90days period from your EC date, many people around me suggest not to take risk.. as case work guidance use wording such as '90 days period MAY considered;

Could any one with similar situation.. please share your experiences
Many thanks

Hi Mazzini
I am not sure for your case as you were on Student VISA, I think someone guru can suggest about your dates to apply.

Vc2013
You can count your 5 years from EC stamp date. My ILR has been granted and I had counted 28 days from EC date before applying however I entered UK almost 1 month after the EC date.

Hope that helps.

Hi ms2013,

It appears you got your ILR, congrats , Have you considered your EC date for counting the 5 years period and booking appointment.? Also, i believe you had your visa valid till 19/08/2013

Appreciated your input.
