EU court Case on Friday - how long to implement changes?

EU court Case on Friday - how long to implement changes?

Hi Guys,

considering that the judgement on the High Court Case will be made on friday what do you think how long it will take the Justice Department to implement the changes (if the court rules in "our" favour)?

I guess about two months. they will probably wait for the written Judgement, then it will go through their iternal legal department, revision of current policies etc. I can't see it taking less then 2 months.

What do you think?

You're assuming, of course, that the Department of Justice wouldn't try to appeal the case if it lost it.

Even if it lost the case and chose not to appeal, there's no guarantee the government wouldn't just simply choose to ignore the ruling.
In a few years time we'll look back on immigration control like we look back on American prohibition in the thirties - futile and counter-productive.

When we get notice of the decision - i think we should organise a standardised letter - demanding action within x number of weeks.

If this is not responded to take it as a group of individuals to the European Commission directly.

Some kind of action should be taken but i think for the time being we all need to remain calm and wait for the ruling once we know the ruling then a plan can be formulated.

I have a more mundane question: given how opaque the Department of Justice is, how will we get news of the High Court decision at all?

Where and when would it be made known to the public?

I have just called the Immigration Council (01 674 0200).
Unfortunately they have not reached a verdict and the case was postponed until 15th of June...

I think it may be time to get together and see what can be done. Maybe we can make a plea, en masse, to a group like the Immigrant Council to do something on our behalf.

I think it may require a whole group of people, because the number of people waiting on EU1s just isn't big enough for the Dept of Justice to care about, obviously, but it might be big enough for others to take notice and put pressure on the DoJ.

I mean: we can't work; we have no residency stamps in our passports, so we're afraid to travel; some of us can't even get our passports back from the DoJ; we don't have a clear method of moving to another EU country because of the lack of residency stamps; we can't get information about the EU1 process from the DoJ; we have no control or influence on this High Court case; and on and on...

This is just ridiculous...it seems asylum seekers and refugees have more rights to have their family join them and work than E.U citizens! Surely a lawsuit or two is in order...

Well, honestly, I'll draft a letter. I think if we each just wrote out a timeline of our EU1 applications, including attempts to call/fax/e-mail the DoJ and traveling (especially what the immigration officers had to say about having no stamp!), I think it will be clear how frustrating and unfair the whole process is.

We can send it into the Immigrant Council, to the DoJ, hell, to the Irish Times.

This is just ridiculous.

If by next Tuesday I dont have news on this, I'm emailing the president of my state about this and CCing some ministers too.

Do the other EU states realize how BS this process is here? Let's get some press interested in it ... as long as we'll be approaching the press [of the spouse's EU country] there might be a chance of something happening .. or at least we can prevent the people who'll still be infected by this from coming here if they are considering some other state as well.

They should do this card system for all the illegal IRISH who are living in the States. Remove all the illegal Irish from the States. And card all the Irish in the States. (well if they are legally they are very carded but make every single of them be forced to carry a LEGAL proof of right of residence there every single day and moment)...

And I'm still expecting that we'll get a negative EU1 since I didn't live with my US husband in another EU country before. (How could I? I was living in Ireland when I met him..)

cartaverde: if you are non-EU and your husband is from US, why are you applying using the EU1? Does he have citizenship of an EU State as well?

Hm... a side thought of that linked article : they are breaking UN human rights with it, sort of .. http://www.un.org/Overview/rights.html

(3) The family is the natural and fundamental group unit of society and is entitled to protection by society and the State.


Protected by which state?? Not Ireland for sure.

Court case is adjourned until June. And they will continue processing the Applications with the current understanding of the law.

The problem is that the Irish government doesn't seem to have ANY understanding of the law.

Its a vain hope that we will be accepted and now we face a wait to see what will happen, and in the mean time we get things straight for immigration into another country not through choice but because we are forced to

looks this one too me. But it says "Hearing" so it means u might not even get a decision on this date
