I applied in sept 2012,got my Coa in oct but heard nothing from them until march wen I had a case of domestic voilence with the father of my son so I had 2 leave him.i got police report and document from social service 2 support my claim.

You are so lucky, I put in my case with a letter from social services, no police report though, I wish I had thought of that. I am still waiting for my reply.. At least this gives me little hope .. Thanks for sharing, you made my day.. :lol:

Don't worry you get a response soon.All the home office want is a prove to show that you the sole carer of your child.like in my case my ex is violent so it won't be ideal to leave my son with him.

Yes you are right, social services included in the letter domestic violence, and me being the sole carer in the letter addressed to home office, so am just praying and hoping to get a good reply.. Enjoy your new freedom, so happy for you.. People keep getting refused , its nice to get some positive news, but I am still getting ready in case I get a refusal.. Congrats once again.. :lol: ..

If u can, see a solicitor first. The forms looks simple but its complicated. Letters from Gp,school,after school clubs,church will do but don't do it yourself without checking with a solicitor. Did u appeal the zambrano?

Is there anyone been refused on the bases that their partner is the Uk, or they have relatives in the UK therefore they can leave their child with them?
Can you please share your the exact words on your refusals.
Was having an discusssion with my lawyer and he seems to think that its illegal for the home office to be refusing people on those grounds.

Zambrano Refused....

Hi all,
I got the decision on my zambrano application on Monday,the case worker mentioned that all the Nhs appointment letters and reports i submitted it was only a piece that was addressed to me,also the per-school letter was addressed to the Parent/carer,also that my son got the British passport thru his daddy,that i need to prove he can't take care of my son and if i could provide more documents showing my name.

They sent the appeal from and all others documents expect my passport since i don't have a valid stay,also that they are giving me time to go back to Africa that if not they will have to remove me by force.
Also said i could do article 8 or appeal their decision..

Please Advice on what next to do...

Hi debab, so sorry for your refusal... I really don't know what they mean by you getting the British passport from the dad, where do they expect you to get it from? The sky? Ukba is now filled with incompetent people dealing with cases, they are so eager to clear these backlog, that they just refuse applications for stupid reasons.. Whenever i get a notification on my phone from this topic, I get really hopeful, but then its the same old thing... We are all hoping for the best...once again, sorry for the news..

EVEN IF THE DAD IS IN THE LIFE OF THE CHILD,,, this is one of the fundamental rights of a child...

A child has a right to a meaningful DIRECT relationship with BOTH parents.

regardless of what the home office believe...

Hi everyone,
It's been quite awhile and an eventful weekend for me. My mum passed away this Sunday in my home country and am so devastated. Still in shock. Then on Monday, my Zambrano application got refused. The HO stated that the Secretary of State is satisfied that I am the primary carer of my son however refused the application because I have provided insufficient evidence to demonstrate that my son will be forced to leave the country if am to be removed. They went on to say my son acquired his British citizenship from his dad (obviously), and also got his passport for him (in 2007) this is 2013! We since split and never even lived together, he's moved from his former address in 2010. And they state that his failure and unwillingness to take care responsibility is not enough proof.
They gave me right of appeal as well as article 8 option. I seemed to know what to do before now. But in this state of grief I really can't think. After 19months, a refusal. What do I do folks please help because I need to travel ASAP.
