Tier 2 General - extension on leave

I am currently in the UK on Tier 2 General visa and my sponsor have withdrawn their sponsorship. They did not notify me when the send notice to UKBA and now I have overstayed the leave granted (although my visa shows expiry in future but without sponsorship it is invalid).

Also my sponsor has not paid my salary and I have submitted claim in employment tribunal. I have got hearing date of next month, but I am afraid that if I go back now then I would not be able to return on time or my visa would be refused (due to overstay).

Can someone help me with what options do I have now? I checked for discretionary leave to remain but I am afraid that if it is rejected then UKBA would definitely ban me from travelling to UK in future.

Can I switch to student visa from within the UK?

Hi,

You need to be specific and give dates for people to help out i.e. when was the sponsorship withdrawn and how long have you overstayed?

How will switching to a student visa help you out in your current situation?The student visa will not allow you to work full time.

I also find it strange that an employer will withdraw their sponsorship without telling you and will also not pay you your salary. I think there is much more to this story and for people to give you the best advice, you need to let us know the entire story.

they gave me notice to withdraw sponsorship but did not told me when exactly they will notify UKBA..

Ideally it should be after end of notice period and not in between (coz that would make my visa invalid and restrict any work)...

There is grace period of 60 days after sponsorship is withdrawn.. In that period I cant work and only look for another sponsorship.. If I find another then well and gud else I have to leave within 60 days.. I have overstayed by 15days after grace period and still have a month before hearing..

I know student visa can allow me to work only for 20 hrs per week.. but not sure If i can switch from Tier 2 General to Tier 4 student in the UK (that too after expiry of my visa)..

I was planning for MBA so it would not be bad idea to switch to student visa... which would also give me time to stay in UK till hearing (even if it is rejected).

If not student.. what other visas can I apply for within the UK?
