Hm.. got an update today.
They are asking for "evidence of residence in this state (rent book etc)" and "evidence of employment of EU citizen".
This after they were sitting on my Irish drivers license for nearly 7 months ... with my Irish address on it.

Are they supposed to ask for these?
They had my drivers license so you'd hope they were smart enough to make a copy of it showing my residence here - since without that residence I would never have got the drivers license. They have access to my tax information if they need to.. I don't personally remember seeing that evidence of employment of EU citizen was on the list of required items. Is it, or do or did they ask this from anyone else?

We also got something today.. an e-mail asking for my details as the non EU person which is a bit mad because they have it all there... it read like this:

Subject: RE: EU1 Application

please supply the nonEEA nationals details.

Could I request that people who post please provide a little more context in their postings. Extracts of emails/letters from Justice do not mean very much unless you explain who they are addressed to and what came before and what questions they raise.

The e-mail was addressed to my husband in response to him mailing them about our EU1 application. The posting I made is the entire e-mail that we received. That is it.. nothing more.

I am yet to receive any reply from the Justice Department, even though we applied more than 6months ago.We have not lived in any other E.U state.
If we get a reply from Justice Department denying our E.U 1 application, what are the legal implications of that Denial? Is the non E.U spouse supposed to leave the country, or is it merely denial of their right to work?
Does someone have any idea?

Solvit are definitely the way to go. This news from them this morning.

Dear Mr. Bird,

SOLVIT Ireland are meeting with the Department of Justice, EU Treaty Rights Section tomorrow to discuss some issues. We will raise your point with them and I will let you know their response.

We are decided if they say no and we have to appeal we will file for America and live on a shoestring till we get in there.
Happy now in the U.K. not so happy about the Rugby

There seems to be at least one recent change. New Residence permits are now issued for the full 5 years, and not for one year anymore.

A friend of my wife got her residence card issued today for 5 years. She had applied via EU1 in November 2006, but had lived in her husbands home country before (even if only for 3 weeks).

Rather interestingly i sent another email to the immigration email address and this is what they sent back.

A decision will be taken in the next two weeks.

Im pleased for you static, cant help but be a bit despondant and as we all know the wait is the killer. we find out in two weeks wether or not my wife gets residency if its a no we are just going to leave we have had enough.

the thing making me crazy here is, i have no communication with the department. how come you people receiving emails from them.

im slightly over 6 months and heard nothing back from them. i have sent emails, letters, and tried to contact them on phone numerouse time but really disappointed holding phone like a stupid!!! visited the department personelly but being turned away by the security guard.

im ended up leaving it all the way it is going........cant really do anything at this stage.
