Some hope for those denied EU Treaty rights (No work though)

Post by jonesdh » Tue May 01, 2007 2:09 pm

A story of hope in a time of despair...

I write this as I sit at Dublin Airport after seeing my wife an American citizen leave for a flight back to the USA. This post is for positive news for any couple currently undergoing the horrible nightmare of the EU1 form.

I (UK) and my wife (USA) were married in Dublin last October under Catholic and State Law. We compiled a much documented application including supporting evidence of the three year relationship and submitted it with our EU1 form to the “justiceâ€

Thanks for sharing that info. Funnily enough I had planned to do the same tomorrow, as my wife will be leaving on friday. Will let you know if it works for me.

But why did you have to pay 100 Euros? shouldn't it be free of charge for Spouses of EU Citizens?

Plaasjapie Member - Please dont be arrogant, it solves noithing. We are all in the same sinking boat here. Stop spamming. Your comments are exactly the type we dont need. Im losing money daily with this farcial application.

==============================================

The E100 fee is only if you are allowed EU treaty rights not if your not. If that makes sense. So if your EU1 was accepted you woulnt pay. However if you get stamp 3 you have to pay! Do what you need to do to get that card!

Good Luck

P.S - The PDs are the Progressive Democrats, Michael McDowell TD is their leader and... the justice minister. So vote again!

We all want treaty rights... thats what there for. What I posted about is not away to get treaty rights its a way to make marrage legitimate and make travel accessable. I have read on this forum posts about couples who havent even had their honeymoon yet. What I proposed above is a solution to that problem.

We have explored all avenues and untill the High Court case this seems to be it!

Direct your anger into a Press release, great story what with the election!

So, Dominic, where is the GNIB? In Dublin? If you live outside of Dublin (I live in Kerry) is there anywhere else that may be able to provide a Stamp 3?

Nice story. Glad something had come of going to the GNIB.

But I'm not sure what the poll has to do with your story? Are you pro or against the PD's? I'd be very surprised that someone in your position would be willing to vote PD's again considering it was their Leader Minister McDowell who proposed and got signed into Law the incorrect interpretation of Directive 2004/38/EC.

As dsab85 asked, why did you have to pay the fee? Spouses of EU citizens DO NOT have to pay visa or registration fees. This has nothing to do with the EU1 form. I'd keep that receipt and complain to Solvit or the EU Ombudsman.

THe GNIB is ON 13/14 Burgh Quay, Dublin 2

THe GNIB website says:

"Outside the Dublin Metropolitan Region (DMR) the Registration Officer is the local Superintendent and you should register at your local Garda Síochána District Headquarters Station" see a list here:

http://www.garda.ie/angarda/stations.html

I have no idea what they will say you may need to get them to call GNIB to confirm. I have no idea what so ever. Best of Luck. Dublins GNIB could only be described as hell on earth! Here is the Kerry Link:

scrudu:

Sorry I seem to be under character assasination from Plaasjapie at the moment. So I will post again:

The E100 fee is only if you are allowed EU treaty rights not if your not. If that makes sense. So if your EU1 was accepted you woulnt pay. However if you get stamp 3 you have to pay! Do what you need to do to get that card!

Im just interested to see if anyone thinks the PDs have ran the justice department well. You will see there are no yes votes!

jonesdh: ok, i get the reasoning behind your poll now.

Regarding the fee, I still think you shouldn't have had to pay that fee, irregarless of the EU1 application. I dont believe the legislation covering this assertation has anything to do with an EU1 application. I'll try to find a Directive which covers this info.

What are you, some kind of genius?

And then you strapped a modem to its head?
Lots of research went into that one...

And then the modem knew how strong the signal was?
Sheesh, mine doesn't do that! O, no, wait, it does...

Don't try to show of here buddy.
A four year in Computer Science doesn't buy you any slack here. Every arse on this board has the equivalent.

I will not sit around while you use this forum as a platform for your political views. we are here because we share a problem. What you vote is your problem.

Keep your politics off the forum and I will leave you alone.
WHAT POLITICS? Unless you missed it the election has been called. Will McDowell be the minister who runs justice in a months time? Thats all Im asking.

My post is about marrage, love, freedom and travel! And hopefully someone else can experience the elation me and my wife had when we got our stamp yesterday.

We have a three month stamp 3 that ran out on the 6th of May.

Hence we wanted a new one it just happens that our denial of Eu traety rights coincided with this new stamp.

We now have it. I only have been through hell and back have sat down to write our full story.
