Section 2.4 evidence

On AN Form section 2.4 I being the eea national do I submit my evidence for the 5 yrs my husband has been resident or is all evidence from my husband or from both of us, does that stand for section 2.5 aswell.
We lived in Italy 2000-2008 and I excercised treaty rights throughout those 8yrs, so we used EU LAW (surinder Singh )ruling to do so see

You should treat that section as a mini EEA4. Check the EEa4 form for evidence required in the case of Surinder Singh but basically they are after the evidence from Italy (again) and evidence for your residence in the UK (normally a passport is enough).

I suggest you add some notes on page 13, as the caseworker doesn't see a Surinder Singh everyday so better to explain on what basis you have obtained PR in the UK.

Do we need to translate any of our evidence that we will be submitting, as some of it will be Italian documentation etc wage slips, contract, residential evidence from local authority in Italy, not to sure as that is all the evidence we used for ea2 residence card, and can we use NCS without having PR in passport

If this was accepted already for a EEA2 application, I don't think you will need to translate it now. You can also mention that on the form.

You can use NCS but be prepared to be required to educate them a bit on Surinder Singh. You might need to ask them to call the HO for some guidance.

Thank you very much information very useful, just nervous really getting closer, I know we will have nothing to worry about but it is the same feeling every time we apply for something new and well this is big his CITIZENSHIP

Do you think NCS is worth the £66 or should we cut out the middle man and send straight to them,

Ask one last thing, if we go through NCS is my husband able to travel alone to his home in morocco while they are processing his application

If he wants to travel, NCS is worth the money as they will copy his passport and give it back to him during the appointment. He is free to travel (assuming his RC is still valid so he can travel back).

No RC not valid ran out 28th may 2013, is that a problem

It means he has no valid visa to travel to the UK. How did he plan on travelling without a valid visa?

Sorry I take that back, just checked his passport and it runs out in April 2014, he reached his 5 yrs residence on the 28th may 2013 from when he entered the uk

I assume he passed the Life in the UK test?

He has passed ESOL in English from accredited college and we have a letter stating hat it has elements of citizenship within it and he lady said that was fine.
