Tier-1 general ILR ...missing visa date and 28 day rule

I have always been to Tier-1 general after my post Study visa. I submitted my first application by post and got visa

from To
09/september/2008 29/August/2011

Then i went for 2nd extension by post but what they have done is given me thee date in extension in resident permit card

from To
31/August/2011 31/August/2013


its look there is no visa for 30 august 2011?..... Is it fine? when i apply for ILR?

If thats ok how early can i apply for ILR ??

Just answering my own question after searching on the forum

"as you applied prior to your visa expiry, your Tier 1 was extended by section 3C so yes, you had visa during the application and it will be counted toward your 5 year stay"

now question i have to clear should i apply 28 days prior to 31/August/2013

or 28 days Prior to 09/september/2013

28 days Prior to 09/september/2013. You will not complete 5 years in case of 31/August/2013

Any senior member please confirm this as i am having mix answers..... someone is saying that i can apply even 28 days before 30 August 2013 as it starts backwards from expiry date

You can apply ILR 28 days before of the 5th anniversary. Therefore, you need to count it from the 1st visa issuance date i.e 09 september. And time you spent under having no visa will be protected by section 3C 1971.

Mine is also same situation.

I booked PEO appointment 28 days before the 5th anniversary not before the Visa Expiry date.

one of my friends brother was also in our position and booked PEO 28 days before 5th anniversary and he got ILR in June last week.

So i Suggest book PEO or post your application 28 days before 5th anniversary

i guess its pretty clear i have to count my days from 5th anniversary not from expiry date
