PR appeals

Hi Folks! My EEA4 application has been refused because my eea partner has been studying without a insurance in its last two years.However, I have been given a chance for an appeal.Meanwhile, he's been offered a job(provisional one).My question is, what are my chances to win an appeal?Plz I need your help 'cause time is running out !! :?

What was your wife doing prior to being a student?

You will be best adviced to proceed with the appeal.

In any event you could secure another Residence Card as she is currently exercising treaty rights.

Hi Obie!
Before becoming student she was working and the Home Office has recognized that period; she did work for almost 3 years and 4 months.
Ok! So it is possible for me to get another Residence Card instead of PR
if I appeal, is that correct Obie? Plz, keep me informed mate.Thanks :?
Should I make another fresh application or just appeal?

If she worked and then commenced studies, depending on the circumstance, a CSI may not be required.

Was she made redundant?

Was her job similar to the course she undertook?

It may well be the case than an appeal is the right course, as UKBA tend not to back downon their unlawful preposition.

Hi Obie, first of all, I'm the most greatiful for your points.

Due to childcare issues she left her job and was given P45; and then

enroled at College for an evening course, without any insurance, as I 've pointed earlier.
By the way,Obie, what does CSI means?

Well if she left, thats different from her being made redundant.

What was her job and what was the course she undertook?

Worked as a Sales assistant and the course was IT and English.

She may well not need a medical insurance to qualify.

On Tuesday, I gonna have a meeting with my solicitor, in order to study on the next step.However I'm very open minded about my situation, I means, would be rather very happy with (having) a Resident Card again.

I will strongly pursue the PR point and use the Residence card as a fall back.

There are lots of uncertainties about UK's position in EU , and your wife has only had a provisional offer.

I strongly believe you are entitled to Residence card, and the decision is wrong in law.

I hope your solicitor shares my view.

Biometric Card

Hope you are doing well! I just got my Residence Card but it is printed onto A4 size paper.What should I do, if anything, to have it
as 'biometric card'.Is there any procedure that I must follow in? Please, any help.Thanks a lot.
