An overstayer is technically an Illegal allien. They are residing in a state without legal right to do so.

The extent of the infringement determines the penalty imposed.

To overstay means to overstay your legal stay. Thus, if it is not legal stay, it is illegal stay.

An overstayer is someone who enters a country with a visa and stays beyond his/her visa.Whereas an illegal is the person entering a country cladenstinely without a visa.
But technically,they are both illegal immigrants

Illegal means anything that is against the law. Murder, Robbery, Rape, Drug dealing are all illegal activities and have different laws which deal with these.

Overstaying is also illegal and there are laws under which people are prosecuted if they overstay.
