EEA marrying with Romanian girl

Hi All


I m new to this forum I have some question.


My college email me that we have report you to UKBA that you have complete your study earlier then expected. My course finish date is April 2013 and the email me on 26 April ....


Then they said you have 60 days to find another sponsor or go back to your home country..


But the main thing is my visa will expire in last week of October 2013.


My question is am I illegal after60 days or not.


Another question plz can I marry with a European girl now in these situations or not...


My girl friend is from Romania. I m from Pakistan. Here in UK on student visa.I just scare from registrar office.[/u]

If your course finish earlier than expected and your remaining length of visa is less than 6 months then it won't be curtailed to 60 days and you can stay until its expiry as per PBS - Tier 4 policy.

Thanks for your quick reply
My course finish date is 31/03/2013 according to CAS letter. But
The college e-mail me on 26 April about the report to UKBA.
IF you think according to e-mail I have less then 6 months. But according to the CAS letter I have around 7 months.
So what you think which one I should consider.
And what is status according to you plz

calculate it from course end date which means it is correct that your visa will be reduced to 60 days.

Bank account and dvla licence. But she just have Romanian passport and I'D
Nothing else. And she don't have work permissions in UK ..
My question Is
can we marry here in England or not.?
What are the basic requirements plz for marriage.?
How long will I get visa?
How much Is my chance to get visa as applying with Romanian girl?

Romanian nationals are facing work restriction possibly till the next earliest year. You need to give marriage notice at any of the 76 designated offices (who work in partnership with UKBA) in UK together with EEA national along with the proof of ID and address.

yes , you can marry, As long as visa is concerned ,romanian national has to be exercising her treaty rights, e,g worker , self employed, student , self suffiecent , As romanians have work restrictions at the moment but they can be self employed , So Romanian national can start a work on a self employed basis and then you can apply for residence card ,which will be for 5 years,,, but its a lengthy ad hard process, good luck

My visa will run out on 20 Oct 2013... If I get marriage certificate before visa expiry date like in September 2013 and I wait until January 2014 because restriction will be lifted and then I apply to Home office for EEA.

Will this be OK or I will be considering overstayed.

if you go to marry just before your visa is expiring then UKBA wont let u marry as they would suspisous as a sham marriage , if you want to marry do it way before your visa expires, and yes u can apply for Rc even after jan 2014,

I understand that I can apply for Resident card in January 2014 when restriction will be lifted...>>

I got one point from your last reply that i should apply to Home office before visa expiring.

I am still a bit confuse that

how my partner will show to Home office that she is exercising treaty rights..???? if I apply before visa expiring...

but I want to apply in January as she will not face hard restrictions..
and in January she will be able to apply easily for national insurance number and to get job in any place....

Apart of thinking about the work restriction on Romanian nationals you should be aware that your sponsor institute has already reported to UKBA regarding the course being finished on 31st March. Therefore, I donot think you have even valid visa now due to 60 days visa curtailment rule. Despite under EU law visa is not necessary but still unless a non-eu national is not recognized the family member of EU, he still subject to immigration rules. Alternatively, Application on Unmarried partner basis can be possible if you have past cohabitation proofs with EU national.

My institution/ College report me to UKBA on 26th April 2013 and my visa will expire on 20 Oct 2013.
From 26 April to 20 Oct 6 days less then 6 months. I think according the Tier 4 policy guidance the 60 days rules is not apply on me because after reporting to UKBA I have less then 6 months stay.
If I have more then 6 months stay then the 60 days rules apply on me.
I think I am right.
I have two more questions in my mind
1) When I get marry with my Romanian partner and we get marriage certificate from the registrars office so will I still consider not a member of EU partner?
2) We are living together from nine months so what is past cohabitation Proof?

Thanks for your email.
I know I wrote wrong in first post that my course will finish in 31/03/2013
But after that I confirm with the college they said your course finish date was 30 June 2013 but they report me on earlier date I.e 26 April 2013.. so my visa expire 20/10/2013.. this is mean I have less then 6 months and 60 days rules will not gonna apply on me. This mean I m not illegal until my visa expires..

Could you plz reply to my previous two questions..

first of all i m very thankful to all members.
i have some confusion in my case and hope will get best suggestion from the senior and junior members.

I am getting marrying with Romanian girl in UK. i am international student and just complete the study.
My visa will expire on last week of October 2013. like 3 months and 10 days from today.
My confusion regarding Further leave to Remain Outside the immigration Rules 'Leave Outside the Rules (LOTR).

if i get marry in a few weeks and get the Marriage certificate and apply for the further leave to remain so my confusion is,

Can i apply through FLRO category or not..

My basic reason for applying for FLRO is, i am waiting for the restrictions which is imposed on Romanian Nationals and these restriction will be lifted on January 2014.

Best is to travel to Romania or Pakistan and get married there.

But you need to show good evidence that you both have been together (pics, email, joint account, joint housing contract, wedding certificate, wedding pics)to show that its not a marriage on convenience.

Although you may apply for FLR(O), there doesn't appear to be any grounds for it to succeed. You won't have a right of appeal if you have remained beyond the curtailment of your leave.
