Switch from tier 1(PSW) to tier 2 GENERAL.

Hi There,

Currently i'm in Tier 1 post study work category, My visa is expiring on nov 2013. And i'm working as System administrator in an IT company over one year. My question is

1. From the ukba code of practice which NQF (wether it is NOF 4 or NOF 6) level do i need to choose?

2. Which SOC code you will suggest to me ?

Nqf 6 level only

Thanks for the reply. May i know the reason why we need to use NQF6. And why can't we use NQF 4.

because the UK wants to limit work related immigration to the more highly skilled jobs and this is reflected in the rules.

This is my first job. Working as a web designer for nearly 1 year and 3 months. I want to know Whether they will categorize me as a experience worker or New entrant?

as you are switching from PSW to T2G you will be considered a new entrant

I heard recently is there any age restriction to switch from PSW to T2G as a new entrants. because im over 27.

There isn't an age restriction on such a switch and you would still be a 'new entrant' as per paragraph 14(d) of Appendix J of the Immigration Rules.

(d) Where both "new entrant" and "experienced worker" rates are stated in Tables 1 to 5, the "new entrant" rate will only apply if the applicant:

(i) is applying as a Tier 2 (General) Migrant and scores points from the Post-Study Work provisions of Appendix A,

(ii) is applying as a Tier 2 (General) Migrant and scores points from the Resident Labour Market Test provisions of Appendix A, on the basis that his Sponsor has carried out a university milkround,

(iii) is applying as a Tier 2 (Intra-Company Transfer) Migrant in the Graduate Trainee sub-category, or

(iv) was under the age of 26 on the date the application was made,

and is not applying for a grant of leave that would extend his total stay in Tier 2 and/or as a Work Permit Holder beyond 3 years and 1 month.

The "experienced worker" rate will apply in all other cases.


The reference to Post-Study work covers various routes and not just PSW, see paragraph 78B of Appendix A of the Immigration Rules.

(2) a Participant in the International Graduates Scheme (or its predecessor, the Science and Engineering Graduates Scheme),

(3) a Participant in the Fresh Talent: Working in Scotland Scheme,

(4) a Tier 4 Migrant,

(5) a Student,

(6) a Student Nurse,

(7) a Student Re-Sitting an Examination,

(8) a Person Writing Up a Thesis,

(9) an Overseas Qualified Nurse or Midwife,

(10) a Postgraduate Doctor or Dentist, or

(11) a Student Union Sabbatical Officer,

Hi, I'm new on the forum. i would like to know the procedure when switching from PSW to tier 2 general. Is it true that i needed to have worked for the employer that want to sponsor me for 6 months before application? Thanks in advance.

That hasn't been a rule for over a year, there is now no requirement to ever gave worked for the sponsor before.
