Hi,
Havent posted here for a long time but I recently had my EEA2 application refused. you can see the timeline below.

The Reason :
I was refused for a stupid reason of sorts, where me and my partner were living in a 4 bedroom house with 2 other housemates at a previous accomodation. The caseworker assumed (and kind off insisted) we were living in 2 different bedrooms even when we had submitted enough evidence suggesting we had been living together. we also had submitted our current accomodation evedience where we live in a one bedroom house for the last 1.2 years.

Anyhow, we have appealed now and I was wondering, what are the appeal timelines people are experiencing right now who are in a similar situation. How long did it take for you to get a letter from the Tribunal with the hearing date.

I appealed on May 31st 2013

Really sorry to hear that you got rejected. Hopefully you will have some good news for your appeal.

May I ask what supporting documents you provided as the evidence of your relationship? (Or if anyone else also applied as unmarried couple, it would be great if you could share your experience here.)

I am in a similar situation like yours. I am applying EEA2 as unmarried partner. I've been living with my partner and his sister. To prove our relationship I have prepared:
1. Council tax bill (have both of our names)
2. my and his bank statements.
3. Pictures of our trips, including visiting his parents & our graduation
4. Tenancy agreement. But only his and his sister's names on it. I will ask his sister to write a letter to prove that we've been living together as I am sharing the room with my partner.
5. Letter from my partner explaining the nature of our relationship.

Is it enough to prove my relationship with my partner?

@Hyao you absolutely have the right documents as long as it cover 2 years period its ok but letter from your partner sister is good but make sure she put her passport data page copy to prove to home office she's legally living in the UK and at same time to know who she is. Sorry for delay i was little busy.
the additional documents can be send on same just mention your case number along your date of birth, nationality, and your name.
write a letter and explain to them why you send additional documents.

my time line .. eea1 and eea2


19 oct 2012 --- COA with no right to work
wife got her RC on 6th of March 2013
I sent an email to HO on 14th June 2013 regarding our application
on 26th June received an email asking which application do I wish to proceed
as my student#s case was with them and my solicitor did not mention anything at all .... (STUPID SOLICITOR) for that we waited 9 months aprox

same day I replied to HO to proceed with my EEA application.
on 6th I got a refund from the student case.
8th I got my RC my solicitor got it ...
have to pay extra £500 to get all my docs from him, but we agreed for £500 and on top of that, what my solicitor did ??? nothing....

can somebody tell me where to complain for this doggie solicitors.

Hi hyao,

Most of the documents you have are great, but..

Regarding the bank statements, if you have a Joint account then that would be great. Even if there is no rule to suggest that you need a joint bank account, some caseworkers will make this an issue. So provide a joint account statement if possible.

Also if you have any other commitments together, then I would advice you submit that too. dont limit your self with providing information. Give them as much as you possibly can, even if its too much. (Its never too much) :)

Also regarding the tenancy agreement, if you have a letter from your landlord suggesting that you live there, that would make your case more stronger. Caseworker wont consider the tenancy agreement as a proof if your name is not on it, so I would highly suggest your landlord and your partners sister write supporting statements.

unfortunately we don't have a joint bank account because we didn't think we have the need to open one. We may consider to open one if that could significantly enhance my application. I did see from other's experience that they only submitted their individual bank statements and the application was successful.

Regarding the tenancy agreement. I must confess that we didn't tell the landlord that i moved in as we were afraid that she might increase the rent. In this case, will the letter from his sister good enough?

Finally I have a very stupid question... Are those letter needed to be hand-written or could be typed then signed?

I know it sounds stupid.. but you can't never be too careful :).

@ hyao yes certified copy is better and try as much documents to link you together on same address for two years period if you are applying as partners. I suggest you use computer to do a neat letter print and duly signed .Good luck

Is 5 months now and she still waiting? Is saddens me that people have to wait for so long till they recieve their rp.i thought it usually don't take that long. Just recently I noticed that people who applied around may june have received their residence permit which is very gd but what happend to fair treatment of individuals right. What is going on and how can this be dealt with. Plz any help. Thanx

my timeline is as follows:
applied in 02 nov 2012
received COA: 01 december 2012
RC.... still waiting

Its more than 8 months now.
About 15 days ago send email to UKBA/Homeoffice.
I've got reply very next day.
In reply it is mentioned that i will get my decision within 2-4 weeks.

now 2 weeks are gone...

would you please tell me how long normally take when they say 2-4 weeks.

I also contacted with my MP as well.
i am waiting for you help.....

Very thanks for your suggestion .
I tried to send them email. but in reply she/he said : case will be dealt within 2-4 weeks. HO not telling anything else.
My MP also contacted with them. MP sent me letter and she said, as soon as she gets any update from HO, she will let me know.


I just want to know when HO says it will take 2-4 weeks it means actually take 2-4 weeks or this reply is for everyone.

6 July 2012 eea2 applied through solicitor
In Dec got Coa with right to work
Nothing after
Sent email to marjeclark two week before
Reply from her she forward my email to team leader of eea2 and team leader reply same as yours your decision will be in 2 to 4 weeks sorry for delay we try to give strive service. Please etc
Only thing is I don't have passport as I was an illegal entry in this country in 1999 and my partner is British with 4 year old daughter

why dont you call HO as well and know the status of your application.

HELP PLEASE

please I am really restless about this.

1. I sent my EEA2 form on 02/07/13 with the old version of EEA2 form with no fees. I had printed the old form since June cos I saved it in my email so didnt bother going back to UKBA website to print another one since I had one. Never thought the form will change and fees apply

2. I sent it to Liverpool instead of the new office DURHAM which they wrote on the new form.., please please, WHAT REALLY SHOULD I DO? this is really confusing
