Returning Resident Visa - More than 2 years outside UK

I have been a regular reader of this forum. Registered now to ask help.

I came to UK in June 2002 as a dependent of work permit holder.
My child was born in December 2002.
I was granted ILR in April 2006.
We had family dispute and I left UK in December 2009 on my own. I have not used any public funds.
My child stayed with my husband.

We divorced in 2010. The degree was issued by a UK court.

I have been working in India since 2010.

I have not visited UK since December 2009.

After reconciliation in 2012, things has changed.
We both, now, wish to live together. We feel responsible for the child's future and don't want to have split family.

We have maintained regular contacts by phone since last November 2012. My child is now 9 years old and in UK.

Since I lived more than 2 year outside UK, what are my chances of obtaining Returning Resident visa.

We are happy to re-marry either in India or in UK.

Which is the best option

1. He travels to India and we get marry here.

Can I apply for Returning Resident visa and what are the chances of getting. Whether I will be asked to apply for dependent visa instead.

2. I travel to UK and get marry there.

Can I obtain Returning Resident visa to travel or they will refuse based on I don't have strong family ties even though my child is there. Or ask me to apply for "Access to Child" visa.

What are the evidence I need to supply.

I thought if we marry, again, I would have strong ties as my child is also there. Is there any reasons why this is not the case and refused.

I think it is possible but need to support with evidence. Better consult with a lawyer
