Studying on PSW then applying for tier 4

Post by Vickyglitz » Sat Jul 20, 2013 3:29 pm

I am planning to study an MBA and my PSW runs out 2 weeks before the course end date. I was wondering if I can apply for a tier 4 just before my PSW is expiring. Your answers would be much appreciated.

How many years you spent on studying prior to PSW? Are you studying as well on psw too?

I spent 4 years doing law. I have calculcated that the 5 year cap does not apply to me. I am working on my PSW now. I know that studying on the PSW does not count towards the cap as well. My only issue is whether I will be able to apply for a tier 4 for just two weeks to complete my course.

If your intention of getting tier 4 is to complete your existing course which remain for only 2 weeks then be informed that you can live legally even till 28 days of your PSW expiry date and during that you can complete your course.

Overstaying even for 1 day is not advisable. Don't jeopardize your future prospect in this country by following unprofessional advice. Try and speak to your establishment about getting CAS, If you have been studying then I am sure they will be in a better position to advise you. IMO, it is not impossible to get CAS even for a limited period, so first speak to them.

You need to read the new ILR long residence guideline effective from April 2013 that illustrate a lot of examples especially relating to 28 days overstaying rule. An applicant is not considered overstayer if beyond to his visa within 28 days he leave the country/make application. You need to read that chapter and then come back to it. All institute must be aware of that too.

The above does not suggest in any way that you must go and over stay, that leverage is there only in inevitable circumstances not when you do have option to go through proper channel.
