I have already written to them but they are waiting for the appeal bundle from the U.K. Those links wont help me coz I have long term depression.

I have already written to my MP and the tribunal to expedite the hearing as the long wait with not help my mental health.

Hi Vinny,

I have received the notice of appeal today and the deadline for the ECM review is 11 weeks. When i sent the documents to the Tribunal, i did not send the Civil Partnership Certificate and out joint bank acct as I have already sent this to them when she applied.

Do I still have to send this? Can I still send it to the tribunal and the post?

Civil Partnership Certificate and joint bank acct are important evidence.

You may send copies of the evidence that you wish to submit.

It is probably safer to assume that the Tribunal will only have the evidence that you submitted to them. Don't assume that they will have any evidence that you haven't submitted to them.

Hi Vinny,

I looked at he document list and we did send it to the Tribunal. Also, I know the deadline for the ECM is the 27th of August but I have been emailing the embassy and my MP has also emailed them but there is no response and I am not sure whether my emails are going through.

What else can I do to request for the ECM review to put forward so I know whether to go home during holidays or not. I did request for it to be seen by 2nd of July but I have not heard from the embassy. The last email I received says that they will try to process it within 1 month from receipt day but I dunno whether they have received it or no. This was the email

Please be advised that the Entry Clearance Manager cannot review an appeal until we receive confirmation from Immigration and Asylum First-tier Tribunal that the appeal has been accepted and payment has been processed.

The Visa Section aims to process non-settlement cases within 1 month upon receipt. However, this is not a guarantee that all appeals will be reviewed within this timeframe, depending on the volume of appeals received by our office.

The Entry Clearance Manager (ECM) will review the decision to refuse the application in light of the Notice of Appeal and any supporting documents. If the ECM is satisfied that the application meets the Immigration Rules, the original refusal decision may be overturned and entry clearance issued.

If the ECM does not overturn the decision, he/she will write a statement to explain in greater detail the reasons for refusing the visa. This will be sent with all of the appellant’s papers (the appeal bundle) to the First-Tier Tribunal, Immigration and Asylum Chamber (IAFT). The appellant will be notified via email if the appeal will proceed and that the appeal papers have been sent to IAFT.

If the refusal decision has been overturned, we will be contacting the applicant by phone or by email to submit the passport so that the visa can be issued.

Hi Vinny,

I hope you can help me. I emailed the post last week and got a response yesterday saying that they have not yet received the documents frm the Tribunal. The tribunal sent all the documents on the 11th of June. Is there anyway of finding this out?

Hi Vinny,

I hope you can help me. I emailed the post last week and got a response yesterday saying that they have not yet received the documents frm the Tribunal. The tribunal sent all the documents on the 11th of June. Is there anyway of finding this out?

Hi,

I spoke to a British friend of mine who is straight and married to a Filipina. He said he submitted less evidence that us but the straight couple's marriage was not even brought up.

If the decision is not overturned by the ECM, coul I possibly add a discrimination case in the arguments?

My friend is willing to testify under oath but what other evidence could I use?

I hope that someone here could reply.

It does look hopeful as they are requesting the applicant's passport. Why would the ECM need it if they are just going to refuse again?

Don't they need the passport if they upheld the original decision? Also, if it is granted, should my partner get the same expiry date as I have on my BRP?

How long doea it take before passport is sent back?

Hello JS28, I'm aware it has been quite a while but what happened in the end with the appeal? I am having a very similar situation with my partner.. Any advice from your experience would be much appreciated!
