Qualifying Period

Hi All

In the 23 of October I will have one year on ILR. I was planing to apply on the 23 this year for naturalisation, but I just notice that on 23 October 2008 I didn't been present in UK. I lend on the the 27 of October. my question are if I can apply on the date 27 October ? even that I just arrive to UK on that date back in 2008. Also the 27 October this year are Sunday and on the 28 there is additional test requirement. yours advice are much appreciated of how shall I treat it..

As it falls in a weekend, you'll have to apply on/after 28th October 2013 and thus be subject to the new rules, if you have a degree taught in English, you should be ok. I assume you're not the spouse/civil partner of a British citizen?

The answer to your question I was on Minster of Religion order. and my wife on spouse visa. what do you if i will make an appointment on Friday with NCS , and i assume they will send the application in same day?? so it will reach Monday morning with date on 27 October ..

I have pass test back in July 2009 ESOL Entry level 3

yes you right , but 5 years qualifying period, is count from the 27 October 2008 to 27 October 2013, even if is weekend, it should be count. there is not any notice that weekend are not count. please correct me if i worng

What do you think about the ESOL i pass ?

BTW it was level 1 , (IELTS 5.5)

The five years qualifying period is calculated counting backwards from the date that the UKBA receives your application.

When you said first year they count the qualifying period can you please explain it ?

If you have physically present in the UK on 27 October 2008, then you can apply on 26 October 2013. Have an appointment on 25 October and make sure this is sent by next day delivery (this is a Saturday. Not sure NCS would use Saturday next day service).

This a great relief news from you.

i have a stump on arrive to UK on the 27 October, so you think if i will make an appointment on the 25 October and i will ask the NCS to send it at the same day in recorded delivery, that mean the HO will receive it on the 26 ??

Please see post i found on the UKBA website ,

For example, if we receive your application on 25 March 2010, you must show that you were in the UK on 26 March 2005.

Hello,
I have a related question. Is it possible to ask NCS to hold on to your application for a few days? Lets say i go there on Friday and ask them not to post it till Tuesday. Would they do that?

I think they except this, i will phone them tomorrow to find out, but way to hold it until Tuesday and not Monday ? also we need to know when the HO will treat the qualifying period from the day receive in the NCS or the date HO receive the application

It is the date that HO receives the application not the date NCS receives it.

I doubt very much the UKBA will be open on a Saturday to accept post, it'll likely be received on Monday 28th October 2013.

Lets said they receive post on Saturday , this ill be the 26 and I arrived 27 October 2008 , is that will be sufficient ??

Hi, I want them to keep my application till Tuesday for other reasons than yours. I need to travel abroad and can only attend NCS on Friday but 5 years ago on that day I was not in the UK. I want them to hold on to it for a few days until the date when I was in the UK 5 years ago. Hence, my question if NCS can hold an application for a few days before sending it to UKBA. If they are not able to do it then I will just post it from abroad directly to UKBA.
Sorry for posting this in your thread. I just thought it was kind of related so did not want to start another one.

I think they can hold it for few days, the problem that we may have is to take the test KoLL B1 Level, as on the 28 October application for ILR and naturalisation must submit their application with new test

I have exactly the same issue than you related to dates and new rules; I got my ILR one year ago on 26th October and being Saturday, the first day to apply would be on Monday 28th October /13.

My best advise is prepare your English test. I have already done IELTS and have everything ready for it. Only thing I'm waiting for is the new forms to fill.

Back in 2009 I also pass the IELTS and my score was 5.5 but that including reading and writing, what are your opinion do i need to re take the test ? as on the certificate showing valid for 2 years ,

The first day UKBA should receive is Friday 25th October.

so the UKBA should receive it one day before ??
please take a look what showing in they are website .

For example, if we receive your application on 25 March 2010, you must show that you were in the UK on 26 March 2005.

Results are fine but as you said IELTS is valid for only 2 years.
