Requirement of Continuous residence period of 5 years

Post by hardikshah13 » Wed Jul 31, 2013 1:57 pm

Hello Friends,

Please find my Tier 1 General visa date as below.

Date of 1st Stamp: 05-01-2009 (3 yrs)
Date of first entry to UK: 13-03-2009
Extension: 05-01-20012 (2yrs)
Tier 1 expires: 05-01-2014

As my entry to UK was delayed by 68 days, can I apply for ILR next or do I need to do one more extension to cover these 68 days short fall?

You should be fine.. if your first entry is within 90 days of visa issue date.

Thanks for your quick reply guys.

I found this UKBA link but can't figure out that if first entry is delayed by 90 days, it is still valid to apply for ILR.

Look on the page 21.

The period between entry clearance being issued and the applicant entering the UK may be counted toward the qualifying period, as long as it does not exceed 90 days.

Thanks for the link but one more question does it apply for Tier 1 General too. as it says Tier 1 (investor, enterpreneur, exceptional telant), highly skilled migrant programme. I can't find tier 1 general in there. :(

I think you should be fine for applying ILR with the 90 day rule, It covers the Tier1 General too as it used to be called HSMP then High skilled migrants Tier1(General) before

Hi params0073,

Can you please let me know what should I put in section 7.11 in set o form

7.11. how long have you lived in the UK? Years Months

Should I put 5 years 0 months or
4 years 10 months as I my first entry was delayed by 68 days.

Thanks for your all help.
